participation in the management of a preschool educational organization;
participation in the development of educational programs for preschool educational organizations;
moral and material incentives for successes in pedagogical activity;
participation in scientific, innovative, international activities in the field of preschool education and upbringing.
Teachers of preschool educational organizations may have other rights in accordance with the law.
It is not allowed to involve teachers of preschool educational organizations in the types of work not related to the performance of their professional duties, with the exception of cases provided by law.
Teachers of preschool educational organizations are required to:
educate and upbring children at a professional level;
observe pedagogical ethics, protect child’s honor and dignity, protect children from manifestations of violence, educate them in the spirit of patriotism, respect for work, legal representatives and respect for the environment;
carry out the state educational program of preschool education and upbringing;
improve their skills;
improve their professional skills and pedagogical skills.
Teachers of preschool educational organizations may also bear other duties in accordance with the law.
It is forbidden to use the educational process for political purposes or to encourage children to commit acts contrary to law.
Article 40. Weekly workload of teachers of state preschool educational organizations
For teachers of state preschool educational organizations, the size of the weekly workload is set in accordance with the law.
The weekly workload of teachers of state preschool educational institutions should not exceed one and a half times the normalized length of working time for this type of work.
Legislation for certain categories of teachers of state preschool educational organizations may establish a different duration of the weekly workload.
Article 41. Remuneration and rest of employees of preschool educational organizations
The size and procedure for remuneration of employees of preschool educational organizations are determined by law.
The salaries of employees of state preschool educational organizations are formed on the basis of:
basic tariff rates established in accordance with the position and qualification category of an employee of a state preschool educational organization;
surcharges and allowances for official salaries.
The following qualification categories are established for employees of state preschool educational organizations:
a specialist with secondary specialized, vocational education;
a specialist with a bachelor's degree or higher education, obtained before the introduction of academic degrees in higher education;
a specialist of the second category with a bachelor's, master's or higher education, obtained before the introduction of academic degrees in higher education;
a specialist of the first category with a bachelor, master or higher education, obtained before the introduction of academic degrees in higher education;
a specialist of the highest category with a bachelor, master or higher education, obtained before the introduction of academic degrees in higher education.
The employees of preschool educational organizations are assigned a shorter working time, are granted annual extended paid leave and benefits provided by law.
Article 42. Teacher’s professional standard
Teacher’s professional standard is applied by employers when:
formation of personnel policy;
hiring teaching staff;
conclusion of employment contracts;
development of job descriptions;
payroll;
organization of teacher training;
certification of teachers of preschool educational organizations.
Teacher’s professional standard can be supplemented by requirements taking into account the cultural, demographic and other features of the territories.
Teacher’s professional standard makes demands on the personal qualities of the teacher, inseparable from his knowledge, skills.
Teacher’s professional standard of a preschool educational organization is approved by the Cabinet of Ministers of the Republic of Uzbekistan.
Teacher’s qualification category of the teacher is granted in accordance with teacher’s professional standard.
Article 43. Certification of teachers of preschool educational organizations
Certification of teachers of preschool educational organizations is carried out at least once every five years.
Certification of teachers of preschool educational organizations is carried out by the State Inspectorate.
According to the results of certification of teachers of a preschool educational organization, the correspondence of a teacher to the position is determined and its qualification category is established.
The certification procedure for teachers of preschool educational institutions is established by the Cabinet of Ministers of the Republic of Uzbekistan.
Article 44. Restrictions on the implementation of labor activity in the system of preschool education and upbringing
Persons recognized as legally incompetent or partially capable, having diseases or physical disabilities that impede the implementation of pedagogical activities, as well as persons previously convicted of committing intentional crimes cannot engage in pedagogical activities in preschool educational organizations.
Persons with whom the employment contract was terminated due to their guilty actions, as well as persons previously convicted of intentional crimes, regardless of the measure of punishment applied, cancellation or removal of a criminal record, and the application of an amnesty or pardon act against them, persons who have committed crimes whose criminal cases are terminated without resolving the issue of guilt cannot be appointed to leadership positions of bodies and organizations of the system of preschool education.
The law may also establish other restrictions on the implementation of labor activity in the system of preschool education and upbringing.
Chapter 8. Social protection of preschool children
Article 45. Nursing and provision of preschool children
The state provides social protection and support for preschool children, especially orphans and children left without parental care, children who need health development correction, long-term treatment and rehabilitation, as well as children from low-income and large families.
The nursing of children with various disorders of physical or mental development is carried out on the basis of partial or full state support.
Orphans and children left without parental care or other legal representatives are fully supported by the state.
Orphans and children left without parental care are guaranteed the right to maintain family relations, as well as to protect their personal non-property and property rights.
Children in need of correction of vision, hearing, musculoskeletal system are provided with means of transportation, prosthetics, orientation and perception of information, as well as other means of individual correction at the expense of the State budget of the Republic of Uzbekistan in the manner established by the Cabinet of Ministers of the Republic of Uzbekistan.
Article 46. Catering for children in preschool educational organizations
A set of natural food products for preschool children, the order of their provision with rational and balanced nutrition, corresponding to physiological age requirements, are determined by the Ministry of Health of the Republic of Uzbekistan together with the Ministry of Preschool Education of the Republic of Uzbekistan.
Food quality control in preschool educational institutions is carried out by the State Inspectorate of Sanitary and Epidemiological Surveillance under the Cabinet of Ministers of the Republic of Uzbekistan, its territorial divisions and preschool education bodies.
Catering for children of preschool age in preschool educational organizations can also be carried out by outsourcing.
Article 47. Protection of children’s health in preschool educational organizations
The protection of children's health in preschool educational institutions includes:
first medical aid;
determination of an appropriate training load;
promotion, formation and training of healthy lifestyle skills;
organization of recreational activities;
compliance with the regime of the day;
organization of a healthy diet;
creation of conditions for physical activity.
Medical care for preschool children is provided by medical workers of preschool educational organizations or relevant healthcare institutions.
The State Inspectorate of Sanitary and Epidemiological Surveillance under the Cabinet of Ministers of the Republic of Uzbekistan and its territorial divisions, together with preschool education bodies, monitor compliance with sanitary rules and norms, hygiene standards in preschool educational organizations. Health authorities, together with preschool education, annually provide free medical examination of children, monitoring and correction of their health.
Medical workers of preschool educational organizations are responsible for compliance with sanitary rules and norms, hygiene standards, as well as the implementation of therapeutic and preventive measures in preschool educational organizations.
Chapter 9. Management of a preschool educational organization and the organization of its activities
Article 48. Management of a preschool educational organization
The management of the state preschool educational organization is carried out by:
pedagogical council;
supervisory board;
head of the state preschool educational organization.
The procedure for managing a non-governmental preschool educational organization is determined by its constituent documents.
Article 49. Pedagogical council of the state preschool educational organization
The pedagogical council of the state preschool educational organization is a collegial governing body of the state preschool educational organization, consisting of pedagogical staff, exercising the authority to discuss issues related to its pedagogical activity.
The pedagogical council of the state preschool educational organization shall:
consider issues of organization and improvement of the educational process in the state preschool educational organization;
determine the work plan of the state preschool educational organization and the pedagogical load of teachers;
evaluate the results of the implementation of the educational program of the state preschool educational organization;
determine the relationship between the state preschool educational organization and child’s legal representatives;
discuss issues of advanced training of teachers of the state preschool educational organization, development of their creative initiative, implementation of the achievements of science and advanced pedagogical experience in the educational process;
consider issues of moral and material incentives for employees of a state preschool educational organization;
hear reports of the head and teachers of the state preschool educational organization.
The pedagogical council of the state preschool educational organization may exercise other powers in accordance with the law.
Article 50. Supervisory Board of the state preschool educational organization
In order to assist in the upbringing, development and education of the child, a Supervisory board is formed in the state preschool educational organization, the composition of which is formed from child’s legal representativesren visiting this organization, its employees, as well as representatives of non-governmental non-profit organizations and other civil society institutions.
The Supervisory board of the state preschool educational organization shall:
determine the priority directions for the development of the state preschool educational organization;
determine the head of the state preschool educational organization from among the candidates recommended by the district (city) department of preschool education for submission to the Ministry of Preschool Education of the Republic of Uzbekistan for approval, and also make proposals for relieving him of his post;
hear reports of the head of the state preschool educational organization on measures taken to improve the activities of this organization, financial and economic status, income and expenses, the use of budgetary, extra-budgetary, sponsorship and other funds;
conduct social surveys regarding the activities of the head and other employees of the state preschool educational organization;
submit proposals to the district (city) departments of preschool education on the promotion of the leaders and other employees of the state preschool educational organization.
The Supervisory board of the state preschool educational organization may exercise other powers in accordance with the law.
The procedure for organizing the activities of the Supervisory board of a state preschool educational organization is established by the Ministry of Preschool Education of the Republic of Uzbekistan.
Article 51. The head of the state preschool educational organization
The head of the state preschool educational organization is the director.
The director carries out the current management of the activities of the state preschool educational organization.
The rights and obligations of the director of the state preschool educational organization are established by regulatory legal acts, the charter of the state preschool educational organization, as well as the employment contract.
Chapter 10. Scientific and methodological support of the system of preschool education and upbringing. Tasks of scientific and methodological support of the system of preschool education and upbringing
Article 52. Scientific and methodological support of the system of preschool education and upbringing
Scientific and methodological support of the system of preschool education and upbringing is carried out:
The Ministry of Preschool Education of the Republic of Uzbekistan and its subordinate scientific and methodological institutions;
The Academy of Sciences of the Republic of Uzbekistan, relevant industry research institutions and higher educational organizations;
Institutions (courses) of retraining and advanced training of leading and pedagogical staff of the system of preschool education and upbringing.
Other scientific and educational organizations can provide scientific and methodological support to the system of preschool education and upbringing in accordance with the law.
Article 53. Tasks of scientific and methodological support of the system of preschool education and upbringing
The tasks of scientific and methodological support of the system of preschool education and upbringing are:
introduction of advanced pedagogical and information technologies into the educational process;
development and production of teaching materials and didactic materials for preschool educational organizations;
conducting research in the field of preschool education and upbringing;
development and implementation of modern methods of preschool education and upbringing management;
analysis and evaluation of the effectiveness of the implemented educational methods and programs in the system of preschool education and upbringing.
Chapter 11. Final provisions
Article 54. Settlement of disputes
Disputes in the field of preschool education and upbringing are resolved in the manner prescribed by law.
Article 55. Responsibility for violation of legislation on preschool education and upbringing
Persons guilty of violating the law on preschool education and upbringing are liable in the prescribed manner.
Article 56. Ensuring the execution, communication, clarification of the essence and significance of this Law
The Ministry of Preschool Education of the Republic of Uzbekistan and other interested organizations shall ensure the implementation, communication to the performers and clarification among the population of the essence and significance of this Law.
Article 57. Bringing legislation into line with this Law
The Cabinet of Ministers of the Republic of Uzbekistan:
to bring government decisions in accordance with this Law;
to ensure the review and annulment by government bodies of their normative legal acts that contradict this Law.
Article 58. Entry into force of this Law
This Law shall enter into force six months after the date of its official publication.
