Summary of Request  

 

The  applicants,  Richard  Bennett  and  Matt  Kezar,  are  requesting  preliminary  plat  approval  of  a 

subdivision comprised of 124 semi-detached single family dwellings on the 33.01 acre site located 

at 1013 and 1015 57

th

 Street East, 33 acres MOL generally located ¼ mile south of SR 64 and east 



of  57

th

th  Street  East  (also  known  as  Morgan  Johnson  Road.).    The  plat  also  encompasses 



delineations for new roads, infrastructure and easements, and common open space.  Zoning is PDP, 

Planned Development Project.  Future Land Use Category is Residential Low, base density 6 units 

per acre. The site lies in flood zones “X” and “A” (no base flood elevation determined.) 

 

Preliminary Subdivision Plat 

2.2.11.b. Subdivision Plat Approval. 

 Preliminary Plat Submission. The application for preliminary approval shall include a completed 

application form, the fee set forth in Appendix A and the Preliminary Plat showing information as 

required  by  Subsection  2.2.11.4.    The  requirement  for  a  Preliminary  Plat  is  waived  for  all 

subdivisions of five lots or less and not new streets. Projections of impacts of the subdivision upon 

roadways, sewer and water, public drainage, school, and recreation facilities shall be submitted 

with the Preliminary Plat for the purpose of concurrency review.  

4.2  Subdivision  of  Land.  This  section  contains  the  design  standards  and  review  criteria  for 

subdivisions.  

4.2.1 Design Standards.

Lots:  The  lots  have  been  designed  to  conform  to  the  standards  set  forth  in  Planned 

Development Project approved on October 11, 2017.  There are 124 semi-detached single 

family lots. The Future Land Use Category is Residential  Low.  The subdivision’s total 

number of units is below the base density requirement of 198 units at 33.01 acres.

Streets:    The  streets  and  infrastructure  within  the  subdivision  will  be  private  and 

maintained by the Amberly Villas Homeowner’s Association, with covenants recorded at 

the time of approval of the Final Plat. All streets and infrastructure will be constructed to 

City of Bradenton standards.   New local streets will meet the required width of 50 feet.  

Easement  noted  as  “Tract  10”  provides  for  a  future  extension  to  the  boundary  of  the 

adjoining property to the East, and will be recorded with the Final Plat.

Natural and Man-made Features of the Site:   The project will maintain a 25 foot buffer 

around  the  onsite  wetland  that  is  avoided  by  the  site  plan.  Areas  defined  as  post-

jurisdictional wetlands/wetland buffers shall be dedicated as a conservation easement with 

the Final Plat approval.  A tree survey and tree removal plan were included in the approval 

of the October 11, 2017 PDP.

Drainage:    Drainage  facilities  are  proposed  to  meet  the  Southwest  Florida  Water 

Management District specifications.

Easements:    Easements  are  included  to  accommodate  public  utilities,  including  sewer, 

water and drainage for each lot in the subdivision. Easements are provided to grant access 

to  private  streets  to  governmental  agencies,  and  to  provide  for  street  continuation  to 

adjacent property. All easements will be recorded with the Final Plat.

Recreation:    The  plat  includes  recreation  areas  that  are  at  a  minimum  of  0.55  acres, 

meeting the minimum recreation area requirement of one-half acre, for subdivisions with 

50 single-unit lots or more.

Sewer & Water:  Sewer and water will be constructed to City standards and dedicated to 

the City.  There is adequate capacity to serve the subdivision at this time.

Schools: There is adequate capacity for all services. The report from the School District of 

Manatee County is attached. School capacity is available or will be available within the 

School Service Area or contiguous School Service Area. 

 

Staff Recommendation  

The application for preliminary subdivision meets the criteria for review and development. The 

preliminary plat is consistent with the Preliminary Planned Development Project (PDP) that was 

approved by City Council on October 11, 2017, with fifteen (15) stipulations.   

 

Staff  recommends  approval  of  SP.17.4054,  based  upon  the  requirements  pursuant  to  Sections 



2.2.11 and 4.2.1 of the Land Use Regulations.
