& 169-36 RENT CONTROL & 169-37 & 169-36. Decreases in Garbage and Solid Waste Removal Fees. [Added 4-25-88 by Ord. No. 88-919] In the event there is a decrease in garbage and solid waste removal fees, the existing Garbage and Solid Waste Removal Surcharge will be decreased. Decreases will be calculated and passed through in the same manner as increases in Section 37. Section 169-32. Garbage and solid waste removal surcharges will be applied against previously imposed garbage and solid waste surcharges in an amount not exceeding such surcharges. If there were no such surcharges, then there will be no reduction. The landlord may subtract from the reduction administrative costs calculated at 1-1/2 times the cost of certified mail, return receipt requested. & 169-37. Garbage and Solid Waste Removal Surcharge Not Considered Rent for Subsequent Increases. [Added 4-25-88 by Ord. Amendments noted where applicable.] GENERAL REFERENCES Peddling and soliciting licenses - See Ch. 135, Art. III. & 172-1. Definitions. For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meanings given herein: GOING-OUT-OF-BUSINESS SALE - A sale held out, advertised, displayed or in any way communicated to the public in such manner as to reasonably cause the public to believe that, upon the disposal of the stock or goods on hand, the business will cease and be discontinued. GOODS - Include any goods, wares, merchandise or other property capable of being the object of a sale regulated hereunder. PERSON - Any person, firm, partnership, corporation, company, organization or entity of any kind.
A license issued by the Township Clerk bearing a license number and the date on which the license was issued shall be obtained by any person before selling or offering to sell any goods at a sale to be advertised, displayed or in any way communicated to the public by any means as a going-out-of-business sale or a lost-our-lease sale. The license must be displayed on the premises, and the license number must be included in all advertising. 17201

or described in the application for a license hereunder for a period of at least six (6) months prior to the date of the proposed sale shall not be granted a license, provided that, upon the death of a person doing business in the township, his or her heirs, devisees, legatees or representatives shall have the right to apply at any time for a license hereunder. Application requirements; fee. A.
make a written application under oath to the Township Clerk, setting forth and containing the following information: (1) The true name and address of the owner of the goods to be sold. (2) A description of the place where such sale is to be held. (3) The nature of the occupancy, whether by lease or sublease, and the effective date of termination of such occupancy to the extent known at the time the application is filed. (4)
The date of the period of time in which the sale is to be conducted. (5)
A full and complete statement of the facts in regard to the sale, including the reason for the urgent and expenditious disposal of goods thereby and the manner in which the sale will be conducted, including the duration of the sale and the proposed days and hours of operation. 17202

A sworn affidavit stating that all merchandise being sold in the sale is in stock, being liquidated, not being replenished and is regularly a part of the store and not brought in for the purposes of the sale. (7)
The means to be employed in advertising such sale, together with the proposed content of any advertisement. B.

7-81 & 172-6 EAST BRUNSWICK CODE & 172-7 & 172-6. Duties of licensee. A licensee hereunder shall: A.
stock of goods, except for goods which are in transit, under contract for the location in question or which are in storage at a warehouse if purchased before application for license. B.
and in any advertisement by handbills, circulars, placards, signs, notices, newspapers or publication or other advertising, including therein the number and date of the license issued by the Township Clerk. C.

Violations and penalties. A. A person not complying with the ninety-day deadline shall be subject to a fine of one hundred dollars ($100.) per day for each day of operation after said license has expired. B. After ten (10) days of violations, the applicant shall be subject to prosecution for fraud. C. A person failing to obtain a license and conducting a going-out-of-business sale shall be subject to a fine of not more than five hundred dollars ($500.) or ninety (90) days in jail, or both. 17204
11-79 & 173-1 SEX OFFENDERS, REGISTRATION & 173-2 Chapter 173 SEX OFFENDERS, REGISTRATION & 173-1. Definitions. & 173-2. Registration and Obligation. & 173-3. Maintenance of Registry. & 173-4. Severability. [HISTORY: Adopted by the Township Council of the Township of East Brunswick 9-29-94 as Ord. No. 94-40.] & 173-1. Definitions. As used in this ordinance, the following definitions shall apply: A.
violation of the following statutes: N.J.S.A. 2C:14-2, N.J.S.A. 2C:14-3 and N.J.S.A. 2C:14-4, where the victim of said crime was a person under the age of eighteen (18). B.
of East Brunswick for more than thirty (30) days in any one year.
A. Any convicted offender who becomes a permanent resident of the Township of East Brunswick shall upon obtaining permanent residence status as defined in this Ordinance register at the East Brunswick Township Police Department. At the time of Registration, the following information shall be supplied by the convicted offender: 1. name and social security number; 2. street address; 3. driver's license number; 4. make, model and license plate number of any motor vehicle owned or used; 5. nature of each and every offense committed; 6. date of each offense and date of each conviction; 7. date of release from custody; 8. prosecuting agency for each offense; 9. age of victim for each offense; B. Obligation to provide the information contained in subsection A above shall be a continuing obligation and any change in any of the information so supplied shall be immediately reported to the East Brunswick Department of Public Safety. 17301 12-94
& 173-3 EAST BRUNSWICK CODE & 173-4 & 173-3. Maintenance of Registry. The Director of Public Safety or his/her designee shall maintain a registry of convicted offenders containing the information required in & 173-2 of this Ordinance in alphabetical order by street name, which registry shall be available at all times for inspection by any person. A copy of the registry shall also be forwarded by the Department of Public Safety to the East Brunswcik Township Board of Education. & 173-4. Severability. A. If any section, subsection or paragraph of this Ordinance is declared to be unconstitutional, invalid or inoperative, in whole or in part, by a court of competent jurisdiction, such section, subsection or paragraph shall, to the extent that is is not unconstitutional, invalid or inoperative remain in full force or effect and no such determination shall be deemed to invalidate the remaining sections, subsections or paragraphs of this Ordinance. B. This Ordinance shall be liberally construed for the protection of the health, safety and welfare of the people of this municipality. 17302

The location, construction, use and m aintenance of individual sewage disposal system s. (2) The m ethod of em ptying or cleaning sewage disposal system s. (3) The issuance of licenses or perm its to locate, construct, em pty or clean an individual sewage disposal system . B. A copy of the code is annexed to and m ade part of this chapter without the text being included herein. & 174-2. Title of code. [Amended 2-11-91 by Ord. No. 91-14] The code established by this chapter is com m only known as the "Individual Sewage Disposal System Code of New Jersey (1978)" as m ore particularly set forth in N.J.A.C. 7:9A-1 et seq. and is hereafter referred to as the "Code." & 174-3. Copies on file. Three (3) copies of the code have been placed on file in the office of the Township Clerk and shall rem ain on file there for the use and exam ination of the public.
[Amended 2- 11-91 by Ord. No. 91-14] A. No person shall locate, construct or alter any individual sewage disposal system until a perm it has been obtained from the Division of Health. B. No new individual sewage disposal system shall be placed in operation and no new dwelling or building or addition to a dwelling or building which relies upon such a system for sewage disposal shall be sold or occupied until the Division of Health has issued a certificate that it has been located and constructed in com pliance with the code and the term s of the perm it issued. C. The application fee for the location or construction of individual sewage disposal system s shall be one hundred dollars ($100.) per proposed/existing lot for the new construction of a sewage disposal system , payable prior to site evaluation. The application fee for the alteration of an existing sewage disposal system shall be fifty dollars ($50.), payable prior to site evaluation. The application fee for the renewal of a license to operate shall be ten dollars ($10.00). The fee is intended to defray costs incurred by the township in reviewing sketches showing the property to be served, location of proposed sewage disposal facilities and num ber of bathroom s, as well as those costs incurred by the township in witnessing the plan review and percolation test and attending to the site inspection, construction inspection and issuance of certificate of com pliance. The application fee is nonrefundable and will not be returned if the certificate of com pliance cannot be issued. [Added 2-24-75 by Ord. No. 75-206; am ended 1-24-77 by Ord. 9-91 & 174-5 SEWAGE DISPOSAL SYSTEMS, INDIVIDUAL & 174-9 & 174-5. Amendments to standard code. Section 10.7 of the Individual Sewage Disposal System Code of New Jersey (1963) is am ended by the following: Applicants who subm it plot plans for properties which are designated by the Natural Resource Inventory as m arginal, or having a high water table and/or heavy clay strata characteristics, will not be perm itted to take percolation tests or soil logs during the m onths of June, July, August and Septem ber. [Added 10-12-76 by Ord. No. 76-206-A] & 174-6. Fee for inspection for cleaning of subsurface disposal systems. [Added 1-24-77 by Ord. No. 77-1-VV; 5-8-89 by Ord. No. 89-20] The fee for inspection for cleaning of a subsurface disposal system shall be fifteen dollars ($15.00) for each cleaning.
