Charnas gives a status update about the Shoreline Master Program update 42
process. Charnas circulates hand-outs from the Department of Ecology on SMP 43

Gustavson points out other counties that have gone through this process and 48
requests a copy of the minutes from the DOE meeting with Jefferson County. He 49
asks about meetings with community groups. 50

Gustavson requests clarification of the definition of a Legacy Lot. 13

Knutson states that a Legacy Lot is a legal, nonconforming lot. For the purpose 15
of this presentation the Board of County Commissioners had requested a broad 16
perspective of Legacy Lots. She continues by addressing what other counties are 17
doing with Legacy Lots. 18

Taylor asks about the build-ability of some of these lots. 20

Discussion is held about development and permitting for some of these sites. 22

Sommerhauser suggests that there are two state Attorney Generals’ opinions 24
about Legacy Lots and would like the Board to receive copies of the opinions. He 25
requests that county legal give some discussion about the applicability and 26
enforceability of those opinions as relates to anything the county might decide to 27
do. 28

Knutson states that this information will be available in the staff report. 30

Motion is made by Commissioner Gustavson and seconded by Commissioner 32
Taylor that county legal brief the Planning Commission so they can ask questions. 33

Gustavson explains that there a questions that the Planning Commission may 35
come up with that did not come from the Board or the Staff that may clarify what 36
they are dealing with. 37

Nevins states that he is not sure that we are to be advised by county legal. 39

Keeton states that they are an advisory group. If they make the motion they 41
should make the motion in the form of a request. The elected official can accept 42
or deny the request. 43

Commissioner Gustavson modifies the motion stating that legal had addressed us 45
on issues previously. 46

Discussion is held about the process of making a recommendation and the 48
information within the staff report. 49

next meeting is a night meeting. 19
