In the course of operational search activities in criminal case No. 220008/2023-10 LJ-information was received about possible contact with employees of foreign special services delivering them information about the socio-political situation in the Republic of Uzbekistan.


For several years, Mohammad Gul Nematulla conducted preliminary negotiations with some officials of the Department of the Customs Committee for Surkhandarya region and transmitted information about persons importing foreign currency from Afghanistan through the checkpoint "Termeznaya Highway" to the territory of our republic to representatives of the Taliban movement through his brother "Ahmad Shoha Mangala".
As a result, it was found that by the time these individuals returned to Afghanistan, representatives of the Taliban had imprisoned them and exerted physical pressure on them.
As part of the pre-trial investigation conducted on the basis of the TCI, the memory of the "iphone12" telephones in a blue case and "iphone12" in a black case belonging to Mohammad Gul Nematullaga, as well as e-mail addresses opened in messengers in the world information networks of the Internet were checked.
In particular, the Telegram messenger to the mobile number +998919059616 has been activated in the Iphone12 b model telephone in a blue case, an e-mail address has been opened at which audio recordings are made with the owner of the profile "Avans Qonsul Moscow", and the Whatsapp messenger to the mobile number +79771000766 has been activated, an e-mail address has been opened, it has been established that audio recordings were made with an employee named Ivan of the Russian consular institution in the Afghan city of Mazar-I-Sharif with the profile "Iwaan".
When these audio recordings were viewed, a man named "Ivan" asked Mohammad Gul Nematulla to provide information about the situation on the border with Uzbekistan, about which consular offices are currently operating in the Afghan city of Mazar-I-Sharif, and which issue visas, it was found that he showed interest mainly in consular institutions Uzbekistan, Tajikistan, Kazakhstan and Turkmenistan, which, in turn, Mohammad Gul Nematulla provided him with information about them on his instructions.
Also, the Whatsapp messenger installed on the phone number +79771000766 was activated through the Iphone 12 phone in a black case, when checking the email, it was found that he was recording audio with the owner of the profile with the entry +93778059999, and the following was sent to him: photos of " Maosher Ahmad Salik " 09.06.2022 25.000, 10.06.2022 30.000, 06.06.2022 26.000, 03.06.2022 35.000... photos of Mohammadi Ahmad Naim 25.000 08.06.2022", photos with a passport photo of an Afghan citizen named AMINI MATIN and currency notes with a face value of 100 US dollars, which were in 12 bundles, a message forwarded with the inscription "AMINI MATIN 23.10.1997, a photo of a civilian passport of an Afghan citizen "Ramin Gulam Murtaza" and 3 photos with cash in in US dollars.
When viewing their correspondence with the help of an interpreter, it was discovered that the owner of the dedicated profile asked Mohammad Gul Nematulla to provide information about persons importing foreign currency from Afghanistan to Uzbekistan, in turn, according to his testimony, it was established that Mohammad Gul Nematulla had transmitted information about these people.
In addition, when the audio and text correspondence in the Arabic alphabet of Mohammad Gul Nematulla with his brother "Najibullo" was checked with the help of an interpreter, "Najibullah" said that Mohammad Gul Nematulla should provide information to representatives of the Taliban about persons importing foreign currency from Afghanistan to Uzbekistan, asked if he had received information from customs officers By asking him to provide information about this as soon as possible, in turn, it was found that Mohammad Gul Nematulla had given him information about these people on his instructions.
Alternatively, when checking the correspondence conducted between Khainazarov Shukhrat Djumanazarovich, the owner of the profile "Shukhrat Termiz", born in 1984, working as a senior inspector of the Surkhandarya regional customs service, and Mohammad Gul Nematulla, it was found that Khainazarov Sh.D. in exchange for material payments provided Mohammad Gul Nematulla with information about citizens of Afghanistan and other states engaged in the importation of a large amount of foreign currency from Afghanistan to Uzbekistan, as well as the information specified in the customs declaration.
According to the expert opinion of the RSEM named after H.Suleymanova dated 17.02.2023 No. 29/11 (472) 26 Z1959, the information contained in the submitted materials may lead to an aggravation of relations between the Taliban movement and the Republic of Uzbekistan in socio-political and other spheres. In particular, obtaining unofficial certificates about Afghan citizens and other persons importing any foreign currency into Uzbekistan, as well as their submission to the Afghan authorities, may in the future lead to the formation of distrust in our republic by the Afghan government and a negative impact on relations between the Taliban movement and the Republic of Uzbekistan, although this is directly It is not aimed at destabilizing the economy and investment climate of Uzbekistan, but it has been established that there are actions that can negatively affect this situation, as well as circumstances detrimental to the economic activity of Afghan entrepreneurs-investors investing in the Republic of Uzbekistan.
Thus, a citizen of the Russian Federation - Mohammad Gul Nematulla, on the instructions of foreign intelligence, by his actions expressed in the transfer of information for use to the detriment of the Republic of Uzbekistan, intentionally committed the crime specified in part 1 of Article 160 of the Criminal Code of the Republic of Uzbekistan.
Based on the above, applying articles 36, 361 of the Code of Criminal Procedure of the Republic of Uzbekistan, decided:
1. To find Mohammad Gul Nematulla guilty of committing a crime under part 1 of Article 160 of the Criminal Code of the Republic of Uzbekistan.
