11. ELIGIBILITY OF DEFENDANT UNDER 18 YEARS OF AGE. [Added 2-23-98 by Ord. No. 98-6] W henever a person entitled to representation by a municipal public defender pursuant to this act, is under the age of 18 years, the eligibility for services shall be determined on the basis of the financial circumstances of the individual and the financial circumstances of the individual's parents or legal guardians. The municipality shall be entitled to recover the cost of legal services from the parents or legal guardians as provided in Section 17 of this Chapter 3-78.1 and the Municipal Court shall have authority to require parents or legal guardians to execute and deliver the written requests or authorization required under applicable law in order to provide the court with access to records of public or private sources, otherwise confidential, as may be of aid to it in evaluating eligibility. 12. REIMBURSEMENT TO MUNICIPALITY. [Added 2-23-98 by Ord. No. 98-6] If the defendant has or reasonably expects to have means to meet some part, though not all, of the cost of the services rendered, the defendant shall be required to reimburse the municipality, either by a single payment or in installments in such amounts as he can reasonably be expected to pay; but no default or failure in making payment shall affect or reduce the rendering of services.
a. The municipality shall have a lien on any property to which the defendant shall have or acquire an interest for an amount equal to the reasonable value of the services rendered to a defendant pursuant to this Chapter 3-78.1 as calculated at the same rate as the Office of the Public Defender bills clients at that time. 353.5
5-98 & 3-78.1 ADMINISTRATION OF GOVERNMENT & 3-78.1 b. To effectuate such a lien for the municipality, the municipal attorney shall file a notice setting forth services rendered to the defendant and the reasonable value thereof with the Clerk of the Superior Court. The filing of the notice with the Clerk of the Superior Court shall constitute a lien on property for a period of 10 years from the date of filing, unless discharged sooner, and, except for such time limitations, shall have the force and effect of a judgment. W ithin 10 days of the filing of the notice, the municipal attorney shall send by certified mail, or serve personally, a copy of the notice with a statement of the date of the filing to or upon the defendant at the defendant's last known address. If the municipal attorney shall fail to give notice, the lien is void.
The municipal attorney is authorized to compromise and settle any claim for services performed pursuant to this Chapter 3-78.1 whenever the financial circumstances of the person receiving the services are such that, in the judgment of the municipal attorney, the best interest of the State will be served by compromise and settlement.
The Clerk of the Superior Court shall provide separate books for the recording of liens established pursuant to Section 13 of this Chapter 3-78.1, which books shall be properly indexed in the name of the judgment debtor. The municipal attorney shall not be required to pay filing or recording fees.
6] The municipality attorney in the name of the municipality may do all things necessary to collect any money due to the municipality by way of reimbursement for services rendered by a municipal public defender pursuant to this act. The municipal attorney may enter into arrangements with any State or county agency to handle collections on a cost basis. The municipal attorney shall have all the remedies and proceedings available for collection which are available for or upon the recovery of a judgment in a civil action and shall also be permitted to collect counsel fees and costs from the defendant for such collection action so that the same are not borne by the municipality. 17. REVIEW OF MUNICIPAL PUBLIC DEFENDER PROGRAM 17.1.
Report. The Township Attorney and the Public Defender for the Township of East Brunswick shall make and submit annually on or before February 15th on the operation of Municipal Public Defender Program for the prior calendar year. The report shall include the following information: a. The number of cases in which a Municipal Public Defender is appointed; b. The cost to the Township of East Brunswick for the services of Municipal Public Defenders; c. The revenues received from fees collected pursuant to Section 5 of this Ordinance; and d. Recom mendations with regard to the operation of the Municipal Public Defender Program. 353.6
5-98 & 3-79 EAST BRUNSWICK CODE & 3-80 & 3-79. Records and papers to be surrendered to successor. All papers, documents, memoranda, reports and other materials relating to the administration of the Department of Law shall be and remain the property of the municipality. Upon the termination of his service with the municipality, each legal officer shall forthwith surrender to his successor all such property, together with a written consent to substitution of his successor in all legal actions and proceedings then pending to which the municipality is a party. & 3-80. The Director of Law shall receive a fixed annual salary, known as a "retainer, as set forth in the annual municipal budget. The retainer shall cover the following services: (1)
Attendance at public meetings of the Council. (2)
Attendance at caucus meetings of the Council. (3)
Conferences with the Mayor and Council. (4)
Conferences with the administrative staff. (5)
Conferences with consultants and other professionals. (6)
Legal advice to the Mayor, Council, administrative staff, boards, commissions, committees, consultants and professionals. (7) Drafting of ordinances and resolutions. (8) All services required on bond ordinances, excluding those services provided by bond counsel. (9)
Representation of the Tax Assessor before the Middlesex County Board of Taxation. DELETED 1-21-97 BY ORD. NO. 97-1. (10) Review and approval of all bid specifications, contracts, deeds and similar documents. [Amended 3-29-94 by Ord. No. 94-19] (11)
Supervision of the bidding procedure. (12)

Administrative functions required of the Director of the Department of Law. B. The retainer shall not include services such as: (1) Litigation and other adversary proceedings. (2) Appearances and hearings before administrative and other boards, bodies or agencies other than those set forth in retainer services. (3)
Land acquisitions. (4)
Municipal Prosecutor services. (5)
Tax foreclosures. (6)
Legal research and drafting of major ordinances, i.e., PUD, major zoning revisions, etc. The major nature of the ordinance will be determined by the Council. (7) Representation of the Municipal Tax Assessor before the Middlesex County Board of Taxation. [Added 1-21-97 by Ord. No. 97-1] 355 11-97

No. 87-861] W ithin the Department of Administrative Services there shall be a W ater Utility which shall have the responsibility of effectuating the purposes of Chapter 218 of the Code of the Township East Brunswick. A. There shall be a W ater Production Section, the head of which shall be the Director of Public W orks and W ater Resources. Under the supervision and direction of the Director of Public W orks and W ater Resources, the Section shall: (1) Use diligence and reasonable care to provide a constant supply of water to consumers in accordance with Chapter 218 of Code of the Township of East Brunswick, as applicable. (2) Operate and maintain the water treatment plant, reservoir, pumping stations and elevated storage tanks. B. The Division of Public W orks and W ater Resources shall be responsible for maintenance, construction and improvement of all capital operations of the W ater Utility. C. The Division of Revenue shall be responsible for collection of all charges, and the Division of Accounts and Treasury shall be responsible for investments of moneys and all such financial operations in conjunction with the administration of water delivery within the Township of East Brunswick. D. There shall be a W ater Policy Advisory Committee consisting of residents of the Township of East Brunswick to advise the Administration, Mayor, Council and/or Planning Board as is appropriate. The W ater Policy Advisory Committee shall be responsible for an on-going review of the W ater Supply Master Plan and report their recommendations from time to time to the Planning Board, the Mayor and Township Council. The Committee shall advise in the operation of the W ater Utility and in the development of a sufficient water supply of adequate quality for the full development of the East Brunswick community and shall annually recommend the water utility budget to the Mayor. The size of the Committee shall be eleven (11) members, one of whom shall be a member of the Township Council to be appointed by the Township Council, and the remaining members to be appointed by the Mayor with the advice and consent of the Township Council for staggered terms of three (3) years each, except that three (3) members shall serve for a one (1) year term and three (3) members shall serve for a two (2) year term at the time the first group of members is appointed. No. 94-1] W ithin the Department of Recreation, Parks and Community Services shall be a Crystal Springs Family Aquatic Center Utility which shall have the responsibility of effectuating the purposes of Chapters 158, 195 and 197 of the Code of the Township of East Brunswick. & 3-83. No. 03-29; 7-7-08 by Ord. No. 08-15] W ithin the Department of Finance there is hereby created and continued a Parking Utility (NJS 40A:1-1) within the Township. The Parking Utility, while organized as a separate function and, for budgeting purposes, is organized for self-liquidating purposes (NJS 40A:4-33) and shall operate as any department within the Township. The East Brunswick Parking Utility shall be organized in accordance with NJS 40:60-25.1 and the Code of the Township of East Brunswick. As any department, the Utility shall be ultimately responsible for its administration to the Mayor and to be under the legislative control of the Township Council. In accordance with & 3-50 of the Code, the Utility shall be under the direction of the Business Administrator. The Parking Utility shall be operated as follows: A. The Department of Finance shall be responsible for maintenance, construction and improvement of all capital operations of the Parking Utility. B. The Department of Finance shall be responsible for the collection of all fees, investments of moneys and all such financial operations in conjunction with the administration of public parking within the Township of East Brunswick. Automobile parking by permit at Transportation and Commerce Center and other Township Parking Utility sites. Automobile parking by permit at the Neilson Parking Plaza [Amended 3-25-91 by Ord. No. 91-31; 8-30-03 by Ord. No. 03-29] (a) Residents of East Brunswick Twenty-five dollars ($25.00) per month [Amended 8-30-03 by Ord. No. 03-29]. (b) Non-residents of East Brunswick Fifty-five dollars ($55.00) per month. [Amended 3-25-91 by Ord. No. 91-31; 8-30-03 by Ord. No. 03-29] (c) Day rate parking without permit three dollars ($3.00) effective October 1, 2003 and four dollars ($4.00) effective July 1, 2004 per day. [Amended 3- 25-91 by Ord. No. 91-31; 8-30-03 by Ord. No. 03-29] (d) W eek-end parking for residents and non-residents $3.00 effective October 1, 2003 and $4.00 effective July 1, 2004 per day. [Added 5-23-88 by Ord. No. 88-931; amended 8-30-03 by Ord. No. 03-29] (5) Replacement fee for lost or destroyed permit $1.00. D. A monthly permit will be sold for parking at the Transportation and Commerce Center and preference will be given to East Brunswick residents subject to rules and regulations to be adopted and implemented by the East Brunswick Parking Utility. E. The parking rates shown in (1), (3) and (4) shall apply to any new lots which are operated by the East Brunswick Parking Utility. F. The Collector of Revenue and the Director of Finance are hereby instructed to account for all parking receipts according to existing state law and subject to the annual audit. In accordance with N.J.R.S. 40:48-10 all moneys received by or on behalf of the Parking Utility shall be paid to the Collector of Revenue, who shall deposit all such receipts within forty-eight (48) hours. H. An annual budget shall be prepared in accordance with N.J.R.S. 40A:4. I. The Parking Utility shall comply with all applicable provisions of N.J.R.S. 40:62. J. The parking rates as delineated and the provisions of the permitted parking system are to be enforced by the Parking Enforcement Officer employed by the Parking Utility. [Added 10-27-97 by Ord. No. 97-30] 1. Driving the wrong way on the parking garage ramps. 2. Parking in a non-authorized area. 3. Parking without payment. 4. Parking without the appropriate permit. 5. Stopping or standing in the buses only lane. 6. Parking across designated stall. 358 1-09 & 3-83.1 ADMINISTRATION OF GOVERNMENT & 3-83.3 K. The penalty for violating the parking rules and regulations shall be set by the Court and listed on the Court's Violation Bureau schedule of fines. [Added 10-27-97 by Ord. No. 97-30] & 3-83.1. No. 79-122] W ithin the Department of Administrative Services there shall be a Construction Inspection Utility which shall have the responsibility of effectuating the purposes of Chapters 49, Architectural Review, 75, Construction Codes, Uniform, and 78, Contractors, Building, of the Code of the Township of East Brunswick.
W ithin the Department of Administration there shall be a Sewer Utility which shall have the responsibility of effectuating the purposes of Chapter 219 of the Code of the Township of East Brunswick. A. There shall be a Collection System, the head of which shall be the Director of the Department of Parks and Public W orks. Under his supervision the System shall [Added 6-14-10 by Ord. No. 10-11]: 1. Use diligence and reasonable care to provide a safe collection system for consumers in accordance with Chapter 219 of the Code of the Township of East Brunswick, as applicable. [Added 6-14-10 by Ord. No. 10-11] 2. Operate and maintain the collection system and pumping stations. [Added 6-14-10 by Ord. No. 10-11] B. The Division of Engineering shall be responsible for design of, construction and improvement of capital improvements of the Sewer Utility. [Added 6-14-10 by Ord. No. 10-11] C. The Division of Revenue in the Finance Department shall be responsible for collection of all charges, and the Division of Accounts and Treasury shall be responsible for investments of moneys and all such financial operations in conjunction with the administration of sewerage delivery within the Township of East Brunswick. A. Department of Finance shall be responsible for the collection of all fees, rate setting, investing of all monies and all such financial operations in conjunction with the administration of the police training utility within the Township of East Brunswick. B. The Department of Public Safety shall be responsible for the staffing, supervision, safety and management of the Utility property known as the Police Firearms Training Facility. 358.1
