& 3-31. Duties. [Amended 4-23-73 by Ord. No. 73-1-U; 12-28-92 by Ord. No. 92- 54] The Clerk shall: A. Keep the minutes and records of the proceedings of the Council and of the proceedings of any special Council committee upon request of the chairman of the committee. B. Preserve and compile all ordinances and resolutions, and at the close of each year, with the advice and assistance of the Department of Law, the Clerk shall compile, codify and bind all the ordinances and resolutions then in effect and shall properly index such compilation or codification and provide for its publication. C. Have and take custody of all the official books, papers and documents of the municipality for which no other repository is provided by the charter or ordinance and preserve and keep them safely. 319 5-82
& 3-31 EAST BRUNSWICK CODE & 3-32.1 D. Provide secretarial and clerical services for Councilmen in the discharge of their official duties. E.
regular working office hours in the Township of East Brunswick, which are 9:00 a.m. to 5:00 p.m. on Monday through Friday, except holidays. F. Receive and process all tax appeals served and filed in accordance with N.J.R.S. 54:3-21. [Added 6-25-79 by Ord. No. 79-144] G. Maintain and administer records of vital statistics including births, deaths and marriages, in accordance with state law and issue marriage licenses pursuant to law. [Added 12-28- 92 by Ord. No. 92-54] & 3-32. Affixing of Municipal Seal. The Clerk shall cause the Municipal Seal to be affixed to instruments and writings when specifically authorized by law or when necessary to exemplify any document or record in his office or to certify an act or paper which, from the records of his office, shall appear to be a true copy of any public record or proceeding. He shall not affix the seal or cause or permit it to be affixed to any instrument, writing or other paper except as provided in this subsection, unless required by law. & 3-32.1 Use of the Logo of the Township of East Brunswick. [Added 11-13-95 by Ord. No. 95-38] A. Purpose The purpose of this chapter is to control and regulate the use of the logo of the Township of East Brunswick. B. Definitions For the purpose of this chapter the following terms shall have the meanings set forth herein
"Township of East Brunswick" shall mean the Township of East Brunswick, its officers, employees, and duly authorized agents and representatives. "Logo of the Township of East Brunswick" shall mean the symbol, or any part thereon, officially adopted to be used by the Township of East Brunswick which includes a graphic design with the words "home, education and commerce" written thereon and the words "plan, purpose and progress" written on a ribbon underneath said design, encircled by a border with the following written words thereon, "Township of East Brunswick, N.J. Heart of Middlesex County" as contained in the Municipal Seal. "Person" shall mean any individual or individuals, corporation, trust, partnership, board, council, commission, committee or any other entity. 320 7-96
& 3-32.1 ADMINISTRATION OF GOVERNMENT & 3-37 C. Permitted Use of the Logo of the Township of East Brunswick It shall be lawful for the Township of East Brunswick to use and display the logo of the Township of East Brunswick to identify the conduct of official business of the Township of East Brunswick as defined in this chapter and to signify attestation of the Township of East Brunswick, as required by the Local Bond Law, N.J.S.A. 40A:2-25 and any other law. D. Prohibited Uses of the Logo of the Township of East Brunswick No person shall use or display the Township logo in an offensive, slanderous or other manner which would degrade the Township of East Brunswick. & 3-33. Publication of ordinances. The Clerk shall publish ordinances as required by law and shall file in his office the requisite proofs of such publication.
The Clerk shall issue and deliver, with the assistance of the Department of Public Safety, if needed, all notices of meetings required to be given to the Council within the time prescribed by law and shall promptly inform Council members of action taken by the Mayor with respect to any ordinances. The Clerk shall also deliver with the assistance of the Department of Public Safety, if needed, all documentation reasonably needed by the Council concerning items or matters scheduled for discussion or action at any Council meeting. Such documentation shall be delivered to Council members at least 70 hours prior to any Council meeting at which the item or matter is scheduled for discussion or action. The Council President, or in his/her absence, the Council Vice President may waive this 70 hours prior notice requirement if he/she believes that such a waiver is in the best interest of the public. Any such waiver shall be in writing and shall include a brief explanation of the reason for the waiver and filed with the Municipal Clerk. Failure to deliver the documentation within the required time period shall not invalidate any action taken by the Council. The consideration by the Council of added starters is to be discouraged, however, added starters may be considered and acted upon provided that the added starter is accompanied by a written explanation of why documentation regarding the same was not delivered to the Council within the above required time period. & 3-35. Administration of licensing provisions. The Clerk shall administer licenses pursuant to ordinance and general law. The Department of Public Safety shall assist in inspection and enforcement procedures required for such licensing. 320.1
11-97 & 3-36 EAST BRUNSWICK CODE & 3-37 & 3-36. Handling of communications. [Amended 5-13-02 by Ord. No. 02-08] The Clerk shall receive and transmit all written com munications directly or indirectly connected with official Township business, including but not limited to any memoranda, correspondence, notes, reports, e-mail, facsimile transmission, or any other writing to or on behalf of the Township Council in accordance with the Handling of Communications Policy as adopted by Council resolution. The Handling of Communications Policy shall be kept on file with the Clerk and may be amended by Council resolution from time to time.
The list of written communications listed above is not intended to serve as an all-inclusive list of communications. Other types of written communications may apply to this section. All written communications directly or indirectly connected with official Township business shall be deemed to be public record in accordance with the Open Public Records Act, P.L. 2001,c. 404 (Jan. 8, 2002).
The Clerk shall charge and receive for the use of the municipality such fees for transcripts and certifications as shall be authorized by the Council. 320.2
3-03 & 3-38 ADMINISTRATION OF GOVERNMENT & 3-42 & 3-38. Additional functions. The Clerk shall also: A. Perform all the functions required of municipal clerks by the General Election Law and any 4 other law or ordinance and receive for municipal use the fees prescribed therefor. B. Perform such functions as are vested in municipal clerks by state law and ordinances relating to bingo and raffles licensing. C. Have such other different and additional functions, powers and duties as may be prescribed by law or ordinance.
The Clerk shall be the depository and custodian of all official surety bonds furnished by or on account of any township office, officer or employee, except his own bond which shall be placed in the custody of the Township Treasurer; all insurance policies upon or with respect to risks insured for the benefit of the township or to protect it against any claims, demands or liability whatsoever; and all formal contracts for work, labor, services, supplies, equipment and materials to which the township may be a party. The Clerk shall also have custody of all leases of property owned by the township. The Clerk shall be the depository for and have custody of all performance bonds running to the township as obligee and other forms of noncash security given by any contractor, subdivision developer or other persons on account of work done or to be done in or for the township. & 3-40. Deputy Clerks. There may be Deputy Municipal Clerks appointed by the Council who shall have, exercise and perform the functions, powers and duties of the Clerk in the absence or upon the direction of the Clerk.
& 3-41. Issuance of certificates for subdivisions of land. [Repealed 6-25-79 by Ord. No. 79-142] ARTICLE IV Mayor and Other Administrative Officers & 3-42. Powers and duties of Mayor. The Mayor shall be the chief executive and administrative officer of the municipality. He shall: A. Enforce the charter and ordinances of the municipality. 321 11-79

& 3-42 EAST BRUNSWICK CODE & 3-42.1 B. Supervise all departments and em ployees and all property and equipment of the municipal government. C. Require each department to make an annual and such other reports of its work as he may deem desirable. D. Appoint all officers and employees for whose election or appointment no other provision is made by charter or ordinance. E. From time to time make such recommendations for action by the Council as he may deem in the public interest. F. Report, annually, at the beginning of the year, to the Council and the public on the work of the previous year and the conditions and requirements of the municipal government for the current year. G. Have such other functions, powers and duties as are provided by the charter and Code.
In accordance with N.J.S.A. 10:5-10, the Mayor may appoint members of the Human Relations Council consisting of 13 citizen members who shall serve without compensation. One of the members shall be a member of the East Brunswick Board of Education, to be selected by the President of the East Brunswick Board of Education and shall serve for a term of 1 year. This member may be appointed as long as he/she remains a member of the East Brunswick Board of Education. As a member, this representative has full voting rights. The Human Relations Council shall attempt to foster through community effort or otherwise, good will, cooperation and conciliation among the groups and elements of the inhabitants of the community. The Human Relations Council is hereby empowered to make recommendations to the Township Council for the developm ent of policies and procedures in general and for programs of formal and informal education that will aid in eliminating all types of discrimination based on race, creed, color, national origin, ancestry, age, marital status, affectional or sexual orientation or sex. Three of the first appointees shall serve for a term of 3 years, two of the first appointees shall serve for a term of 2 years and two of the first appointees shall serve for a term of 1 year. Thereafter, all appointments shall be made for 3 years. All new appointments shall first be approved by a majority of Hum an Relations Council members before final Mayoral appointment. If a vacancy occurs in the middle of a term, it shall be filled by the Mayor with the approval of a majority of Human Relations Council members to complete the unexpired portion of the remaining term. 322
7-96 & 3-42.2 ADMINISTRATION OF GOVERNMENT & 3-43 & 3-42.2. Emergency Management Organization. [Amended 3-9-81 by Ord. No. 81-337; 3-28-88 by Ord. No. 88-913; 1-28-02 by Ord. No. 02-02] The Emergency Management Organization shall be headed by the Municipal Coordinator of Emergency Management who shall be a resident of the Township and shall be appointed by and serve at the pleasure of the Mayor. The Municipal Coordinator shall have the functions, powers and duties of a municipal disaster control director as provided by law. The Director shall appoint a Deputy Municipal Coordinator of Emergency Management with the approval of the Mayor. The Deputy, wherever possible, shall be appointed from among the salaried officers or employees of the Township. A Local Disaster Council with powers and duties prescribed by general law is hereby created. The Council shall consist of no more than fifteen (15) persons and shall be appointed by and serve at the pleasure of the Mayor. The Municipal Coordinator of Em ergency Management shall be a member and serve as Chairman of the Council. The Director of Public Safety may also serve as Municipal Coordinator of Emergency Management. & 3-43. Acting Mayor. The Mayor shall designate the Administrator, any other department head or the Clerk to act as Mayor whenever the Mayor shall be prevented by absence from the municipality, disability or other cause from attending to the duties of his office. During such time the person so designated by the Mayor shall possess all the rights, powers and duties of the Mayor. W henever the Mayor shall have been unable to attend to the duties of his office for a period of sixty (60) consecutive days for any of the above-stated reasons, an Acting Mayor shall be appointed by the Council, who shall succeed to all rights, powers and duties of the Mayor or the then Acting Mayor. 322.1 3-03
& 3-44 ADMINISTRATION OF GOVERNMENT & 3-46 & 3-44. Interim appointments. W henever a vacancy exists in any office required by the charter or Code to be filled by the Mayor with the advice and consent of the Council and there is no holdover incumbent, the Mayor may temporarily fill such vacancy, in the absence of any contrary provision in the charter or ordinances, by appointing an acting officer, including the designation of himself as Acting Business Administrator in the event of a vacancy in that office. Such appointee shall have all of the functions, powers and duties of the office until it shall be filled permanently. Any such appointment shall terminate not later than forty-five (45) days after the date of the appointment, unless the Council shall by resolution authorize one (1) or more extensions of such period.
A. Each department shall be headed by a director who shall be appointed by the Mayor with advice and consent of the Council. Each department head shall serve during the term of office of the Mayor appointing him and until the appointment and qualification of his successor. B. The Mayor may, in his discretion, remove the Administrator or any department head after notice and an opportunity to be heard. Prior to removing a department head, the Mayor shall first file written notice of his intention with the Council, and such removal shall become effective on the 20th day after the filing of such notice unless the Council shall, prior thereto, have adopted a resolution by a two-thirds vote of the whole number of the Council, disapproving the removal.
Each department head shall: A. Appoint and, with the approval of the Mayor, remove or suspend subordinate officers and employees within his department subject to the provisions of Chapter 28 of the Code of the Township of East Brunswick. B. Direct and supervise the work of the department and its employees. C. Assign functions, powers and duties to subordinate officers and employees within the department and modify such assignments, as need appears. D. Delegate to division heads such of his powers as he may deem necessary for efficient administration. E. Adopt rules and regulations pertaining to his department. No rule or regulation made by any department shall, except upon written approval of the Mayor, take effect until at least ten (10) days after it is filed with the Township Clerk as required by the charter. This limitation of time shall not apply, however, to any order, rule or regulation which relates solely to the organization or internal management of the municipal government or a part thereof. The Clerk shall maintain a docket of all orders, rules and regulations filed in his office, which docket shall show the name of the issuing department, a brief description of the subject matter and the date of filing. In the case of personnel rules and regulations, a written copy of the rules and regulations shall be distributed to the personnel of the department affected thereby and shall be posted in the office of the department director. Copies shall also be available to personnel of the department upon request. 323 9-82
& 3-46 EAST BRUNSWICK CODE & 3-47 F. Report at least annually to the Mayor and Council in such form as shall be approved by the Administrator on the work of the department during the preceding year. Due to the fact that smoking is a m ajor cause of disease, disability, public nuisance and irritation to smokers and nonsmokers alike, it is hereby provided that smoking shall be prohibited at all meetings of all township boards, agencies, commissions and other bodies, to which meetings the public has been invited. Notices shall be posted at all such meetings and on announcements of such meetings indicating the following: "Smoking not permitted during meetings of East Brunswick boards, commissions and agencies."
