The creation of a competitive environment and anti-monopoly legislation in Uzbekistan

The existence of competition requires the existence of certain conditions. These conditions can exist only in an environment where market relations are established. Therefore, the creation of a market economy means the formation of a competitive environment at the same time.

In countries with developed market relations, the competitive environment has evolved over a long period of time. This gradually created an environment of free competition.

As the principles of monopolization become stronger in the economy, competition is limited, therefore the state also participates in creating a competitive environment. This, as noted above, is reflected in the state's anti-monopoly policy. Depending on the exact situation in each country, i.e., the degree of monopolization of the economy, depending on its scale and description, this policy focuses on creating a new environment of free competition, maintaining it, restoring it if necessary, and deciding on the methods of competition.

In countries transitioning from the administrative-command economy to the market economy, including our republic, the preparation of conditions for healthy competition, the expansion of the independence of economic entities and their involvement in competition are important aspects of the measures aimed at the implementation of economic reforms. After all, as the President noted, today "... strong demand and competition make further deepening of economic reforms an objective condition. There are still many unsolved problems in this regard. That is, to completely abandon the patterns of the old administrative-distributive system, to further limit the state's intervention in the economy, to provide practical guarantees for free entrepreneurship, to develop the economy and business stably,5.

Today, monopolies in the form of associations, concerns, corporations, and companies are preserved in Uzbekistan, and they often have the positions and tasks of line ministries. The old system of distribution of certain types of products and raw materials in the form of limits and funds, as well as the existing administrative barriers for business implementation, such as issuing permits, licenses, certificates, agreements, create more opportunities for monopolistic tendencies.

The President of our country I. Karimov once again drew attention to these problems in his speech at the meeting of the Cabinet of Ministers dedicated to the end of 2007 and emphasized the following: "It is known that the development of the economy at the current stage, issues of fighting against monopolistic manifestations and creating a competitive environment in practice are extremely important.

...At the same time, the monopolization of the economy in some sectors remains at an unreasonably high level, which still prevents the growth of production volume, the increase of product quality and competitiveness, and the decrease of prices.

In particular, among these, the ability to satisfy the need for cement, slate, polyethylene, light and oil industry products and a number of other goods remains relatively limited.

And this helps monopolist companies to unreasonably increase the price of their products when the demand for these products has increased.6.

Accordingly, in order to create an effective competitive environment in Uzbekistan, it is necessary to implement the following measures:
