Consistency with legislation of other jurisdictions
Although the current age of criminal responsibility in Queensland is consistent with some other
common law countries, including England, Wales and the USA, it is not consistent with the
global standard. The age ranges from seven years old in Libya, Egypt, Sudan and parts of the
US, to 12 in Canada and Mexico, 14 or 15 in most of Europe and parts of South America, and
16 in Argentina, Angola and Mozambique. China, Russia, Germany, Spain, Sierra Leone,
Azerbaijan, Cambodia and Rwanda have all raised the minimum age of criminal responsibility to
14 years old. A study of 90 countries in 2008 showed that the most common minimum age of
criminal responsibility is 14.
While the minimum age of criminal responsibility is currently 10 years old in all Australian states
and territories, the ACT Government has committed to raise the age to 14 years old, and a Bill
has been introduced to the Victorian Parliament to do the same. The Northern Territory
Government previously indicated it would implement a recommendation of the Don Dale Royal
Commission to raise the age of criminal responsibility to 12 years old and ban the detention of
those aged 12-14 except for serious crimes, however the law remains unchanged to date.
