For that, Farooq Sahib will consult his colleagues and decide. Same way, Congress will do," he said. On newspaper reports about NC's decision to join hands with Congress for the Assembly polls, Omar said, "If I take as truth whatever comes in newspapers, this world would be (of) a different kind. I came to understand it soon that whatever I read in papers, very less of that is based on reality." To a question about "delay" in announcing mandates by the party, Omar said, "This is not a race. The race is for winning the elections." "If by announcing the mandates, elections would have been won, then I would have announced them six years back. It does not make a big difference. When we will be ready with the mandates, we will tell you," he said. The Chief Minister said he was "fully ready" for the elections in the State. "My confi- dence was never low. I have taken blows sometimes, but those blows also make you more confident and I am fully ready for the forthcoming test," he said. (PTI)
The increase in state levies such as entry tax and octroi led to prices of domestic LPG rising in Kerala by Rs 4.50 per cylinder, Rs 3 in Karnataka, Rs 5.50 in Madhya Pradesh and Re 1 per cylinder in Uttar Pradesh. There was a small increase of 2 paise and 8 paise in PDS kerosene rates in Haryana and Uttar Pradesh, respectively. On the other hand, a reduction in state levies led to a cut in LPG prices by Rs 9.50 per cylinder in Assam, Rs 1.50 in Bihar and Rs 3 per cylinder in Maharashtra. Rates of kerosene sold through the public distribution system fell by 11 paise per litre in Maharashtra and Rs 1.32 per litre in Navi Mumbai. The Oil Ministry on Wednesday ordered that the hikes in both LPG and kerosene rates be put on hold pending consultations with the state govern- ments on state-specific levies. However, the reduction in prices will be passed on to consumers, an official statement said here on Wednesday. Besides excise duty levied by the Central Government and sales tax or VAT by state governments, certain other local levies such as entry tax, octroi and input tax restrictions on VAT are applicable in some states. "In order to ensure that revenue demands of certain states don't become a burden for consumers across the country, the government had introduced the scheme of State Specific Costs (SSC) on 24th July, 2012, to recover such irrecoverable levies from the consumers of the state/municipal area levying such taxes," the statement said. In accordance with the scheme, oil companies carry out quarterly revisions in the Retail Selling Price (RSP) of sensitive petroleum products, including PDS kerosene and domestic LPG, in 12 states where such taxes were incurred. The latest revision in these states was due this month. "The govern- ment has the interest of consumers utmost in its mind and has therefore decided to insulate the consumers from the impact of any increase in the RSP of domestic LPG and PDS kerosene due to revision of SSC," the statement said. It has been decided that the revision of LPG and PDS kerosene prices for those consumers on account of upward revision of SSC would be deferred till discussions are completed with state governments. "The Chhari Mubarak will begin its journey from Srinagar to the Holy Shrine on 6th August, with night halts at Pahalgam, Chandanwari, Sheshnag and Panchtarani," Giri said. He said it would proceed for the Holy Cave for Pujan from Panchtarani at 5:00 AM on 10th August, Shravan-Purnima to have the Darshan and tradi- tional rituals would be performed and prayers shall be offered the whole day at the Holy Cave. "On 12th August, after the Puja and Visarjan ceremonies at the bank of river Lidder in Pahalgam, Chhari Mubarak will return to Srinagar. And with these last rituals, the annual Amarnath Yatra will culmi- nate", Giri said. Two BJP leaders -- Shahnawaz Hussain and Rajiv Pratap Rudy -- and Reliance Industries Chairman Mukesh Ambani were accorded 'Z' category security during Shinde's tenure. "No decision has been taken so far. But threat perceptions of all VIPs will be reviewed and security will be given accordingly," the official said. A committee, headed by the Union Home Secretary, periodically reviews the threat perception of VIPs and, accordingly, recommends security for them. A 'Z-plus' category protectee is entitled to security with a total of 25 com- mandos, a 'Z' category protectee gets a cover of 11 security personnel while a 'Y' category VIP gets security of two armed commandos. A Home Ministry statement said that Home Minister Rajnath Singh was on Wednesday apprised of the security arrangements for VVIPs/VIPs. Singh called for the security arrangements to be reviewed and suitably strengthened wherever required. "Section 498-A of the IPC was introduced with avowed object to combat the menace of harassment to a woman at the hands of her husband and his relatives. The fact that Section 498-A is a cognisable and non-bail- able offence has lent it a dubious place of pride amongst the provisions that are used as weapons rather than shield by disgruntled wives. "The simplest way to harass is to get the husband and his relatives arrest- ed under this provision. In quite a number of cases, bed-ridden grand-fathers and grand-mothers of the husbands, their sisters living abroad for decades are arrested," the Bench said. The Bench said the arrest curtails freedom, brings humiliation and casts scars forever and no arrest should be made only because the offence is non-bailable and cognisable. "The existence of the power to arrest is one thing, the justification for the exercise of it is quite another. Apart from power to arrest, the police officers must be able to justi- fy the reasons thereof. "No arrest can be made in a routine manner on a mere allegation of commission of an offence made against a person. It would be prudent and wise for a police officer that no arrest is made with- out a reasonable satisfaction reached after some investigation as to the gen- uineness of the allegation," the Bench said. Referring to crime statistics, the Apex Court said 1,97,762 persons were arrested in 2012 for offence under Section 498-A and nearly a quarter of those arrested under this provision were women depicting that mothers and sisters of the husbands were liberally included in their arrest net. "Its share is 6 per cent out of the total persons arrested under the crimes committed under Indian Penal Code. It accounts for 4.5 per cent of total crimes committed under different sections of penal code, more than any other crimes except theft and hurt," it said. It said the rate of charge-sheeting in cases is as high as 93.6 per cent, while the conviction rate is only 15 per cent, which is lowest across all heads and as many as 3,72,706 cases are pending at trial stage. The Apex Court said that police in the country has not come out of its colonial mindset. "It has not come out of its colonial image despite six decades of independ- ence, it is largely considered as a tool of harassment, oppression and surely not considered a friend of public. The need for caution in exercising the dras- tic power of arrest has been emphasised time and again by courts but has not yielded desired result. "Power to arrest greatly contributes to its arrogance so also the failure of the magistracy to check it. Not only this, the power of arrest is one of the lucrative sources of police corruption. The attitude to arrest first and then proceed with the rest is despicable. It has become a handy tool to the police officers who lack sensitivity or act with oblique motive," it said. The Apex Court said that failure of police officials will be liable for department proceed- ings and amount to contempt of court for not complying with its direction. It said, "Authorising detention without recording reasons as aforesaid by the judicial magistrate concerned shall be liable for departmental action by the appropriate High Court." "Our endeavour in this judgement is to ensure that police officers do not arrest accused unnecessarily and Magistrates do not authorise detention casually and mechanically," it said. The Apex Court said a person accused of offence punishable with imprison- ment for a term which may be less than seven years or which may extend to seven years with or without fine, cannot be arrested by the police officer only on its satisfaction that such person had committed the offence. It said police officer before arrest, in such cases has to be further satisfied that such arrest is necessary to prevent such person from committing any further offence or for proper investigation of the case or to prevent the accused from causing the evidence of the offence to disappear. "Law further requires the police officers to record the reasons in writing for not making the arrest. In pith and core, the police office before arrest must put a question to him- self, why arrest? Is it really required? What purpose it will serve? What object it will achieve? "It is only after these questions are addressed and one or the other conditions as enumerated above is satisfied, the power of arrest needs to be exercised. In fine, before arrest first the police officers should have rea- son to believe on the basis of information and material that the accused has committed the offence," the Bench said. "We are of the opinion that if the provisions of Section 41 CrPC which authorises the police officer to arrest an accused without an order from a Magistrate and without warrant are scrupulously enforced, the wrong com- mitted by the police officers intentionally or unwittingly would be reversed and the number of cases which come to the Court for grant of anticipatory bail will substantially reduce," the Bench said. The services of the doctors shall also be governed by the terms & conditions mentioned in their selection letters issued to the Chief Medical Officers.
