No. 09-09] The School Board or the Chief Adm inistrative officer in the case of any private or parochial elem entary or secondary school is hereby directed and shall have the continuing obligation to prom ptly notify the Township Engineer and the Township Attorney of any changes or contem plated changes in the location and boundaries of any property owned by or leased to any elem entary or secondary school or school board and which is used for school purposes. & 158-18. No. 09-09] The Township Clerk is hereby directed to receive and to keep on file as an official record the original of the Drug-Free School Zone Map approved and adopted pursuant to &158-15 of this article and to provide at a reasonable cost a true copy thereof to any person, agency or court which m ay from tim e to tim e request such a copy, along with a certification that such copy is a true copy of the m ap approved and adopted herein and kept on file. It is hereby further directed that a true copy of each such m ap and of the ordinance enacting this article shall be provided without cost to the Middlesex County Clerk and to the Office of the Middlesex County Prosecutor. & 158-19. The m aps approved and adopted pursuant to &158-15 of this article were prepared and are intended to be used as evidence in prosecutions arising under the crim inal laws of this state, and, pursuant to N.J.S.A. 2C:35-7, these m aps shall constitute prim a facie evidence of the following: (1)
The location of elem entary and secondary schools within the Township of East Brunswick
(2)
The boundaries of the real property which is owned by or leased to such schools or a school board.
(3)
That each such school property is and continues to be used for school purposes. (4)
The location and boundaries of areas which are on or within 1,000 feet of each such school property. B. All of the property depicted on the m aps approved and adopted herein as school property was owned by or leased to an elem entary or secondary school or school board and was being used for school purposes as of March 17, 2009. 15817 -09 & 158-19 EAST BRUNSWICK CODE & 158-22 C. Pursuant to the provisions of N.J.S.A. 2C:35-7, as am ended by P.L. 1988, c. 44 and PL 1997,c. 181, a prosecutor is not precluded from introducing or relying upon any other evidence or testim ony to establish a violation of the offense defined in that statute, including use of a m ap or diagram other than the ones approved and adopted pursuant to &158-15 of this article. The failure of any m ap approved herein to depict the location and boundaries of any property which is, in fact, used for school purposes and which is owned by or leased to any elem entary or secondary school or school board, whether the absence of such depiction is the result of inadvertent om ission or the result of any changes in the location and boundaries of such property which have not yet been incorporated into a revised approved m ap, shall not be deem ed to be an official finding and record that such property is not owned by or leased to an elem entary or secondary school or school board or that such property is not used for school purposes. D. All of the requirem ents set forth in N.J.S.A. 2C:35-7, as am ended by P.L. 1988, c. 44 and PL 1997,c. 181, concerning the preparation, approval and adoption of Drug-Free School Zone Maps have been com plied with. & 158-20. Drug Free Public Park and Public Building Zone Map. [Added 4-6-09 by Ord. No. 09-09] In accordance with and pursuant to the authority of P.L. 1997 c. 327 (N.J.S.A. 2C:35-7.1) as am ended by P.L. 1988, c. 44 and PL 1997,c. 181, the Drug-Free Public Park and Public Building Zone Map prepared by Gregory Potkulski, PE, Manager of Engineering Services, dated March 17, 2009, is hereby approved and adopted as an official finding and record of the location and areas within the T ownship of East Brunswick of property which is utilized as public parks and public buildings, owned, leased or controlled by the Township of East Brunswick, and of the areas on or within 500 feet of said properties. & 158-21. Map to Continue in Effect.
The Drug-Free Public Park and Public Building Zone Map approved and adopted pursuant to &158-20 of this article shall continue to constitute an official finding and record of the location and boundaries of areas on or within 500 feet of the real estate com prising public parks and public buildings owned, leased or controlled by the Township of East Brunswick until such tim e, if any, that this article shall be am ended to reflect any additions or deletions with respect to the location and boundaries of the public housing facilities, public parks and/or public buildings and drug-free public areas within the Township of East Brunswick.

It is understood that the m ap approved and adopted pursuant to &158-20 of this article was prepared and is intended to be used as evidence in prosecution arising under the crim inal laws of the State of New Jersey, and that pursuant to state law, such m ap shall constitute prim a facie evidence of the following: (1)
The location of public parks and public buildings owned, leased or controlled by the Township of East Brunswick. (2) The boundaries of the real property which is utilized in connection with public parks and public buildings owned, leased or controlled by the Township of East Brunswick. (3)
That such property continues to be used as public parks and/or public buildings. (4)
The location and boundaries of areas which are on or within 500 feet of such public parks and public buildings. B. Except as is otherwise expressly noted on the face of the approved m ap, all of the property depicted on the m ap as drug-free public park and drug-free public building area was owned, leased or controlled by the Township of East Brunswick and was being used for public parks and/or public buildings as of March 17, 2009. C. Pursuant to the provisions of P.L. 1997, c. 327 (N.J.S.A. 2C:35-7.1), a prosecutor is not precluded from introducing or relying upon any other evidence or testim ony to establish a violation of the offense defined in that statute, including use of a m ap or diagram other than the one approved and adopted pursuant to &159-20 of this article. It shall be unlawful for any person to willfully or maliciously torture, torment, beat, kick, strike, mutilate, injure, disable or kill any dog used by the Police Department of the Township of East Brunswick in the performance of the functions or duties of such Department or to interfere with or meddle with any such dog while being used by said Department or any member thereof in the performance of any of the functions or duties of said Department or of any officer or member of said Department. & 163-2. No. 99-10] The Property Maintenance Code of the Township of East Brunswick shall be administered by the Zoning and Code Enforcement Officer, and/or his/her designee within the East Brunswick Department of Planning & Engineering. Summonses for violation of this code shall be signed by the Zoning and Code Enforcement Officer or his/her designee within the East Brunswick Department of Planning and Engineering. At the discretion of the Zoning & Code Enforcement Officer or his/her designee, no notices, orders or hearings to abate will be issued when the following violations have occurred: 1. Any violation that , based on reasonable belief and good cause, the code official deems a hazard to public safety or welfare. & 166-4. Buildings. [Deleted 2-22-99 by Ord. No. 99-10] & 166-5. No. 99-10] In addition to any other remedies which may be available, the Director of Public Safety or his representative, upon affidavit, may apply to the East Brunswick Municipal Court Judge for a search warrant setting forth factually the actual conditions and circumstances that provide a reasonable basis for believing that a nuisance or violation of this ordinance exists on the premises, and, if the Judge is satisfied as to the matter set forth in the affidavit, he shall authorize the issuance of a search warrant permitting access to and inspection of that part of the premises on which the nuisance or violation may exist.
& 166-6. Responsibility of Owners and Operators. [Amended 2-22-99 by Ord. No. 99-10] Owners and operators shall have all the duties and responsibilities prescribed in this Code, and no owner or operator shall be relieved from any such duty and responsibility nor be entitled to defend against any charge or violation thereof, by reason of the fact that another person or entity is also responsible therefor and in violation thereof.
