& 3-114.1 ADMINISTRATION OF GOVERNMENT & 3-115 & 3-114.1. Copy of Police Accident Reports. [Added 8-22-88 by Ord. No. 88-949; amended 6-14-93 by Ord. No. 93-32] DELETED 10-25-10 BY ORD. NO. 10-24 & 3-114.2. Breathalyzer Ampoules. [Added 2-26-90 by Ord. No. 90-8] The following fees shall be charged for furnishing breathalyzer tests ampoules, which require specialized handling and packaging because the ampoules contain concentrated acid - $7.50.
A fee of ten dollars ($10.00) shall be charged for each tape recording of Township proceedings. & 3-114.4. Municipal Court Discovery. [Added 10-25-04 by Ord. No. 04-18] 1. All request for discovery in matters pending in the East Brunswick Municipal Court shall be submitted through the Municipal Prosecutor. 2. The following fees shall be payable by the requestor to the Township of East Brunswick for the discovery provided: a. $.75 per page for each of the first 10 pages photocopied b. $.50 per page for each of the next 10 pages photocopied c. $.25 per page for each of the pages photocopied thereafter d. Actual postage for any discovery sent by mail e. $.25 for the envelope for any discovery sent by mail f. Photographs will be photocopied at the rates established herein. If requests are made for duplicate photographs, the actual cost of making the photographs shall be charged. g. Duplication of videotapes constitute an extraordinary duplication process and will be charged at the rate of $5.00 per videotape. h. On any item that cannot be photocopied on the Township copy machine or not otherwise provided for in this schedule, the actual cost incurred in making the copy shall be charged.

W here the discovery must be obtained from an entity other than the Township of East Brunswick, e.g. another police department, the actual costs paid to the other entity shall be paid to the other entity shall be paid by the requestor. & 3-115. Copying by person requesting documents permitted. W here the document in question is more than one hundred (100) pages in length, the Clerk may permit the person requesting copies to use his own copying machine, provided that there is no risk of damage or mutilation of the documents and that it would not be incompatible with the transaction of public business. Such determination shall be completely within the discretion of the Clerk. 383
-11 & 3-116 EAST BRUNSWICK CODE & 3-118 & 3-116. Copies of topographic map. [DELETED 6-12-95 by Ord. No. 95-18; amended 2-22-99 by Ord. No. 99-9] The topical maps of the area of this township prepared by Atlantis Aerial Survey Company, Inc. compiled from photography dated December, 1996 consisting of topographic maps at scales of 1"=30' with 1' contours can be purchased at the fee established in Section 3-114 of this code. A digital form (AUTOCAD) of these topographic maps can be purchased at an additional fee established in Section 3-114 of this code. In order to prevent physical damage/deterioration to these maps, tracing of these maps by any means is not permitted. No person who purchases a print, sepia, digital or other form of reproducible copy of any street or portion of a sheet of the aforesaid topographic maps shall sell or permit the sale of such print, sepia, or digital form or the sale of any reproduction or copy thereof or the sale of any portion thereof or the sale of any reproduction or copy of a portion thereof.
The following fees shall be charged for assigning a police officer or a special reserve police officer on quasi-duty and/or traffic duty:
Traffic Duty Overtime Rate for Senior Patrolman [Amended 4-24-06 by Ord. No. 06-18] Quasi-Duty $34.00/hour & 3-117.1. Fees for services and reimbursement of costs - HazMat. [Added 9-8-97 by Ord. No. 97-26] A. Fees for services and reimbursement of costs is hereby authorized in accordance with Chapter 85 P.L. of 1991 permitting local municipalities to recover the cost incurred for emergency response to HazMat incidence. The Chief Finance Officer based upon support documents provided by the Public Safety department is authorized to bill responsible part causing the HazMat incident and seek reimbursement for equipment, salaries at the burden rate, and materials required and used to contain the hazardous material spill based upon inventory cost. B. The Chief Finance Officer is authorized to seek reimbursement from the State of New Jersey through the Spill Compensation and Control Act (P.L. 1996 C 141). & 3-118. Disposition of fees. The fees collected under this Article shall be deposited in the East Brunswick Township General Revenue Account. 384
12-06 & 3-118.1 ADMINISTRATION OF GOVERNMENT & 3-121 & 3-118.1. Schedule of Fees for Mayor Services. [Added 4-16-07 by Ord. No. 07- 15] A. The purpose of this section is to establish policies and procedures for the collection of fees associated with the performance of marriage or civil union ceremonies by the Mayor. B. Persons seeking to be married or joined in civil union by the Mayor of the Township of East Brunswick shall remit a fee of $50.00. The fee shall be payable to the Township of East Brunswick. Fees collected shall be deposited in the Trust Fund to be appropriated by Township Council’s Resolution. C. The Mayor may waive said fee at his/her sole discretion. ARTICLE XIX Township Seal [Added 3-9-65 by Ord. No. 65-6] & 3-119. Official Seal established. [Amended 12-9-68 by Ord. No. 68-6-A] The seal set forth below is hereby fixed and established as the Official Seal of the Township of East Brunswick.
The Official Seal shall be kept in the office of the Township Clerk who shall be the custodian thereof.
The Township Clerk shall cause the seal to be affixed to all instruments, documents and writings when required or authorized by law or any ordinance or resolution of the Council. The Clerk shall also cause the seal to be affixed when necessary to exemplify or certify any act or paper which, from the records of his office, shall appear to have been an official act of the township or a true copy of any official instrument, document or writing of the township. He shall not affix the seal or cause or permit it to be affixed to any instrument, document or other writing except as herein above provided. 385
9-07 & 3-122 EAST BRUNSWICK CODE & 3-123 ARTICLE XX Protection for Township Officials [Added 4-11-90 by Ord. No. 90-14] & 3-122. Protection for Township Officials. [Amended 11-22-93 by Ord. No. 93- 68] It is the policy of the Township to provide full and complete protection to all of its officers and employees from and against any and all suits, claims, and demands in regard to their respective activities arising out of and related to their public duties and public employment to the maximum extent permitted by law and in accordance with the following standards. A. W henever an officer, employee, or member of a Township board, agency, commission or any other legally constituted body of the government of the Township of East Brunswick is a defendant in any action or legal proceeding arising out of or incidental to the performance of his duties, the governing body of the Township of East Brunswick will provide said person with necessary means for the defense of such action or proceeding, but not for his defense in a disciplinary proceeding instituted against him by the Township of East Brunswick or in a criminal proceeding instituted against him by the Township of East Brunswick or in a criminal proceeding instituted as a result of a complaint on behalf of the Township. If such disciplinary or criminal proceeding instituted by complaint of the Township of East Brunswick shall be dismissed or finally determined in favor of such person, he/she shall be reimbursed for the expense of his/her defense. B. The Township will indemnify any such person referred to in the previous paragraph, other than for professional malpractice claims and hold him/her harmless from any award of monetary damages in any such legal proceeding and from any and all legal costs and expenses incurred in connection with such action regardless of the lim its of insurance coverage available to the Township. [Amended 11-22-93 by Ord. No. 93-68] C. In any such legal proceeding, the Township will waive any rights for contribution, indemnification or reimbursement from such person on account of any monetary damages awarded against such person or for any legal expense or other costs incurred in connection with any such action, whether or not such amount exceeds insurance coverage available to the Township. D. The Township will not be responsible for legal costs and expenses incurred by such person relative to the retention of separate counsel on behalf of said person unless the Township specifically approves the nature of costs and separate counsel retained by such person in advance together with the fees and costs that can be anticipated. E. None of the rights and benefits outlined above shall be afforded to such person if it is established that his conduct was outside the scope of his employment or constituted a crime, actual fraud, actual malice or willful misconduct. & 3-123. Exempt Firemen. [Added 2-24-97 by Ord. No. 97-6] Pursuant to N.J.S.A. 40A:14-60 & 63 exempt firemen who are employees of a municipality may not be terminated for political reasons, but only for good cause after a fair and impartial hearing. The Township of East Brunswick wishes to adopt this fair and reasonable protection for its exempt firemen as part of its Municipal Code. Therefore, the provisions of N.J.S.A. 40A:14-60 and 40A:14-63 are hereby made a part of the Municipal Code of the Township of East Brunswick. 386 11-97

3-06 SALARIES AND COMPENSATION Chapter 35 SALARIES AND COMPENSATION [The salaries and com pensation of the various officers and em ployees of the Township of East Brunswick are set by the Township Council by ordinance. Copies of current salary ordinances, as am ended, are on file in the office of the Township Clerk and are available for inspection during regular office hours.]
N.J.S.A 43:15B-1 provides that any m unicipality m ay establish a deferred com pensation plan whereby the em ployer m ay enter into written agreem ent with any of its em ployees thereby providing a voluntary deferral of salary and such deferral shall rem ain in effect until the em ployee is term inated or until a new contract is executed by the em ployee and em ployer. T he provisions of the salary deferral shall be in accordance with N.J.S.A. 40A:4-2 of the local budget law, which requires that one or m ore public officials, or the governing body as a whole, shall be designated and nam ed to the fiduciary responsibility for adm inistration of said plan and investm ents. The deferred com pensation plan which is established shall be in com pliance with Section 457 of the Federal Internal Revenue Code and recent am endm ents as adopted by the Congress through Revenue Acts of 1978 which require that all eligible state deferred com pensation plans com ply with the classification system s to guarantee com pliance with regulations of the I.R.S., the Securities and Exchange Com m ission, the Departm ent of Social Security and the State enabling legislation. The adm inistration of the deferred com pensation plan is recognized as a critical factor and the rules and regulations provided for im plem entation shall be prom ulgated by the Township Adm inistrator and Director of Finance and listed as part of the adm inistrative procedures m anual clarifying such questions as, the interface with the local payroll system ; who shall be the plan coordinator; how collections of paym ents shall be m ade; the role and responsibility of custodial functions; to insure appropriate deferrals and safeguard with stringent control for accuracy, safety and tim eliness of investm ents. Also individual participants should receive annual statem ents which reflect both the value of contributions and the total am ount which has been contributed. T o insure com pliance with the federal regulations, clear procedures providing for an em ployee's withdrawal of funds m ust be established and an annual review of these procedures should be initiated each year. Nothing herein shall obligate the Township of East Brunswick to set up or m aintain a deferred com pensation plan. [Added 10-22-79 by Ord. No. 79-190]

AIR POLLUTION CONTROL 2 Section 18:2. Notwithstanding the content of any state statute, and notwithstanding the provisions of Section 18.01 of the Middlesex County Air Pollution Control Code, any private citizen m ay file a com plaint in the East Brunswick Municipal Court alleging violation of the Middlesex County Air Pollution Control Code. No prior notice to the alleged violator is required. [Amended 5-31-90 by Ord. No. 90-23] 4201 6-91
Editor's Note: The m onetary penalty provision in Section 16: 1 of the Middlesex County Air Pollution 1 Control Code, adopted by the Township of East Brunswick, is hereby am ended by increasing the m axim um m onetary penalty from $500.00 to $2,500.00, pursuant to N.J.S.A 26:2 C-22, as am ended. If the m onetary am ount should be increased by State Statute, the Township of East Brunswick penalty shall autom atically be increased to equal that am ount. Editor's Note: Chapter 42, Air Pollution Control, adopted on 5-10-82 as Ord. No. 82-444 was repealed 2 and rescinded on 11-26-84 by Ord. No. 84-612.
