& 228-5 EAST BRUNSWICK CODE & 228-5 1. In the event that no application for development of at least twenty-five (25) acres in the MMH Zone covering Block 324, Lot 1 has been filed with the East Brunswick Department of Planning and Engineering by July 1, 1986, then the MMH zoning designation for Block 324, Lot 1 shall be rescinded and that zoning shall revert to R-1 (Single Family Rural Residence). [Amended 4-24-89 by Ord. No. 89-12] 2. The Director of the Department of Planning and Engineering shall certify to the Township Council on July 1, 1986 the extent to which an application for development, if any, has been filed to provide low and moderate income housing on Block 324, Lot 1. [Amended 4-24-89 by Ord. No. 89-12] 3. In the event that the Director of the Department of Planning and Engineering shall certify to the Township Council that an application for development of low and moderate income housing has not been filed for at least twenty-five (25) acres on Block 324, Lot 1 by July 1, 1986, the zoning map of the Township of East Brunswick shall be deemed to have been changed in accordance with this Ordinance thereby deleting the MMH designation for Block 324, Lot l and providing the MMH designation for the property described in Schedule A annexed hereto. [Amended 4-24-89 by Ord. No. 89-12] 4. This amendment is being made pursuant to a settlem ent of litigation against the Township of East Brunswick. W .
Adoption of Zoning Map. There is hereby created an H-1 (Hotel - Convention Center) option zone on lands bounded by Naricon Place to the south, Route 18 to the west, Lawrence Brook to the north and northwest and the New Jersey Turnpike to the east, notwithstanding the fact that the boundary of the new H-1 option zone is not shown on the Zoning Map of the Township of East Brunswick dated July, 1978. The following lot and block is to be removed from the H-1 Option Zone: Block 2.02, Lot 2.15. [Added 8-14-84 by Ord. No. 84-598; amended 9-24-84 by Ord. No. 84-605] X.
Adoption of Zoning Map. The C-3 (General Commercial) District and Zone as shown and described on the Zoning Map of the Township of East Brunswick dated July, 1978 is hereby enlarged to include Block 26.01, a portion of Lot 7, and Lot 9.02 and the entirety of Lot 8 as more particularly described on Schedule A annexed hereto, which property is hereby rezoned from O-1 (Office, Professional and Apartment) to C-3, notwithstanding the fact that the enlarged boundaries are not shown on the Zoning Map. The C-2 (Neighborhood Business) Zone as shown on the Zoning Map of the Township of East Brunswick dated July, 1978 is hereby enlarged to include Block 322.05, Lots 1 and 2, as more particularly described on the East Brunswick Township Tax Map, which property is hereby rezoned from P-1 (Planned Industrial Park) to C-2

Adoption of Zoning Map. The RP-2 (Single-Family Rural Preservation Transition) District and Zone as shown on the Zoning Map of the Township of East Brunswick dated July 1978 and as am ended is hereby enlarged to include Block 308.21, Lot 18.24, as more particularly described on the East Brunswick Tax Map, which property is hereby rezoned from C-2 (Neighborhood Business) to RP-2 (Single-
Family Rural Preservation Transition) notwithstanding the fact that the enlarged boundaries are not shown on the zoning map. [Added 8-30-89 by Ord. No. 89-68] II. Adoption of Zoning Map. The HC-2 (General Highway Com mercial) District and Zone as shown on the Zoning Map of the Township of East Brunswick dated July 1978 and as amended is hereby enlarged to include lot 1 in block 713.02, as more particularly described on the East Brunswick Tax Map, which property is hereby rezoned from R-3 (Single Family Residence) to HC-2 (General Highway Commercial), notwithstanding the fact that the enlarged boundaries are not shown on the zoning map. [Added 5-14-90 by Ord. No. 90-17] JJ. Adoption of Zoning Map. The C-2 lands on Riva Avenue are to be rezoned to RP in accordance with the Master Plan adopted on April 4, 1990. The C-2 Neighborhood Business District and zone as shown on the Zoning Map of the Township of East Brunswick dated July 1978 and as amended is hereby enlarged to include that portion of Block 87.33, Lot 1, in accordance with the Town Green Amendment of the Comprehensive Master Plan. 7-99 & 228-5 ZONING & 228-5 NN.
Adoption of Zoning Map. The VG-I Village Green I District and zone as shown on the Zoning Map of the Township of East Brunswick dated July 1978 and as amended is hereby enlarged to include all of Block 87, Lots 10.02, 10.03 in accordance with the Comprehensive Master Plan. The R-2 and Town Green designations for the property is deleted. These lands include the Block and Lots as more particularly described on a map and a metes and bounds description on file in the Office of the Township Clerk, and as more particularly described on pages annexed hereto. (Refer to section 228-289) [Added 3-8-99 by Ord. No. 99-6] OO. Adoption of Zoning Map. The C-2 Neighborhood Business District and zone is hereby enlarged and shown on the zoning map of the Township of East Brunswick to include the Blocks and Lots as more particularly described on a map on file in the office of the Township Clerk, and as more particularly described on pages annexed hereto. The RP Rural Preservation District and zone as shown on the Zoning Map of the Township of East Brunswick dated March 1999 and as amended is hereby enlarged to include lands formerly zoned R-1, R-3, OP-1, C-2 and MMHC in accordance with a Master Plan Amendment to the Comprehensive Master Plan. These lands include the Block and Lots as more particularly described on a map and a metes and bounds description on file in the Office of the Township Clerk, and as more particularly described on pages annexed hereto. The R1 Single Family Rural Residence District and zone as shown on the Zoning Map of the Township of East Brunswick dated March 1999 and as amended is hereby enlarged to include lands formerly zoned RP these lands include the Block and Lots as more particularly described on a map and a metes and bounds description on file in the Office of the Township Clerk, and as more particularly described on pages annexed hereto. The RP-3 Rural Preservation Low Density Residential District and zone is hereby created and shown on the Zoning Map of the Township of East Brunswick to include the Blocks and Lots as more particularly described on a map on file in the Office of the Township Clerk, and as more particularly described on pages annexed hereto. 10-10 & 228-6 EAST BRUNSWICK CODE & 228-6.2 & 228-6. Interpretation of boundaries. W here there is uncertainty as to the boundaries of any of the districts shown on the aforesaid map, the following shall apply: A. The district boundary lines are intended to follow street center lines and lot or property lines as they exist at the time of enactment of this chapter unless indicated by dimensions on the Zoning Map. B. Questions concerning the exact location of district boundary lines shall be determined by the Board of Adjustment in accordance with rules and regulations which may be adopted by it as hereinafter provided. ARTICLE II-A Regulations for the RP Single-Family Rural Preservation District [Amended 1-14-80 by Ord. No. 79-203; 8-27-01 by Ord. No. 01-28 ] 3 & 228-6.1. Applicability of provisions of Article. Unless specifically prohibited in this Article, the following regulations shall apply to all R-P Districts.
The purposes of the RP Single-Family Rural Preservation District are: A. To promote the retention of existing agricultural lands and to support ongoing agricultural activities through a combination of land use policy, acquisition of development rights, creative development techniques and limitations on land use activities that interfere with continued farming; B. To retain the largely undeveloped and rural character which pervades western and southwestern East Brunswick, in part by limiting the introduction of growth-inducing infrastructure; C. To provide land use management strategies which promote the conservation of sensitive natural resources and which limit the impact of future development of this area; D. To promote the conservation of open space through public acquisition, acquisition of less than fee interests and implementation of land use policies supportive of permanent preservation of open space areas; E. To support the objectives of the State Development and Redevelopment Plan including the retention of large contiguous areas of agriculture and open space, and providing for development which respects the carrying capacity of land and water resources while also preserving unique and sensitive natural areas. 22839.3

C. Structures used for private and commercial horticultural, agricultural or forestry purposes, exclusive of greenhouses; provided that no structure or areas enclosing farm animals of any kind shall be within seventy-five (75) feet of any lot line. D. All agricultural activities and farm related uses of land which meet the definition in the New Jersey Farmland Assessment Act. E. Buildings used exclusively by the federal, state, county or local government for public purposes. 22839.4

ZONING & 228-6.6 & 228-6.4. Conditional Uses. A. Churches based upon the following standards: 1. Minimum lot size shall be twelve (12) acres; 2. Maximum lot coverage shall be forty (40) percent (%); 3. Maximum building coverage shall be ten (10) percent (% ) 4. Septic system approval shall be obtained prior to Board action. B. Schools for Academic Instruction based upon the following standards: 1. Minimum lot size shall be twelve (12) acres; 2. Maximum lot coverage shall be forty (40) percent (%); 3. Maximum building coverage shall be ten (10) percent (% ) 4. Septic system approval shall be obtained prior to Board action. & 228-6.5. Permitted accessory uses. A. Home occupations as defined in &228-3B of this chapter. B. Private garages as defined in &228-3B of this chapter, provided, however, that the garage shall be for not more than three (3) private cars or two (2) private cars and one (1) commercial vehicle as defined in 228-224C. C. Greenhouses are a permitted accessory use and structure provided that the aggregate square footage of all structures situated on the site do not exceed 55,000 square feet or fifteen percent (15% ) coverage of the total lot area, whichever is less. D. Landscape contracting, tree pruning services, firewood processing, wood mulches, and sales of products grown on the site are permitted accessory uses to the permitted principal agricultural, horticultural or forestry use of the site. E. Cottage industry when conducted as an accessory use on the same tract as a permitted principal agricultural or horticultural use and as defined in &228-3B of this chapter. Such use shall be clearly incidental and secondary to the use of the property for agricultural or horticultural purposes and does not change the character thereof.
Prohibited uses and buildings are as follows: A. Any uses and buildings not listed in Sections & 228-6.3, 228-6.4 and 228-654 above. B. Professional occupations. 22839.5 1-02

Newspaper Vending Machines. F. Limousine or livery service. G. Storage yard for wreckers and damaged or disabled vehicles associated with a wrecker operation. H.
