Penalty. Any person owning, operating, renting or perm itting the use of a cigarette vending m achine on prem ises under his or her control shall be subject to a fine of $250.00. A. There is hereby established in the Township of East Brunswick a State Uniform Construction Code enforcing agency to be known as the "Division of Construction Inspection," consisting of a Construction Official, Building Official, Fire Protection Subcode Official, Elevator Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall thereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency. The Administrator shall make 7501 3-00
& 75-1 EAST BRUNSWICK CODE & 75-2 or cause to have made an analysis of the duties and responsibilities of the Construction Official and all subcode officials and recommend to the Council a position-classification plan. [Amended 10-23-78 by Ord. No. 78-78] B. Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended, and N.J.A.C. 5:23. More 1 than one (1) such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such 2 position. C. The public shall have the right to do business with the enforcing agency at one (l) office location, except for emergencies and unforseen or unavoidable circumstances. & 75-2. Construction Board of Appeals. [Amended 9-26-05 by Ord. No. 05-28] A. There is hereby established a Construction Board of Appeals to hear appeals from decisions by the enforcing agency. Such Board shall consist of five (5) members, plus one (1) alternate member. At least one (1) Board member shall be a registered architect or licensed professional engineer of building construction experience, and at least one (1) Board member shall be as qualified as a Plumbing Subcode Official and one (1) as qualified as an Electrical Subcode Official. No more than two (2) Board members shall be selected from the same business or profession. Each Board member shall have had at least three (3) years' experience in construction, design or supervision as a licensed engineer or registered architect or, in the alternative, five (5) years' experience in construction, design or supervision as an architect or engineer with a bachelor's degree in architecture or engineering, respectively, from an accredited institution of higher education or, as a further alternative, ten (10) years' experience in construction, design, or supervision as a journeyman in a construction trade or as a construction contractor, subcontractor or inspector. At least one (1) Board Member shall be certified as a NJ Fire Marshall or Official by the Division of Fire Safety. [Amended 9-26-05 by Ord. No. 05-28] B. The Mayor, with advice of Council, shall appoint the Board members and any alternate members. For the members first appointed, the Mayor shall designate the appointees' terms so that one (1) shall be appointed for a term of one (1) year, one (1) for a term of two (2) years, one (1) for a term of three (3) years and two (2) for a term of four (4) years. At the expiration of such terms and thereafter, appointments shall be made for terms of four (4) years. Vacancies shall be filled for the unexpired term. C. The Mayor shall appoint such number of alternates, as may be appropriate, for terms not to exceed four (4) years or may, in the alternative, appoint alternates on a case-by-case basis.
D. No regular or alternate Board member may be a member of the enforcing agency, the decisions of which are subject to the review of the Board. E. All members and alternate members shall serve without compensation. 7502 3-06

The Construction Board of Appeals is hereby authorized to appoint an Attorney to represent it, the appointment being made at the first regular meeting of the Board after January 1 of each year. The term of the Attorney shall be for a period of one (1) year or until the appointment and qualification of his or her successor. The compensation to be paid to the Attorney shall be established by the Township Council in the annual municipal budget. [Added 5-8-78 by Ord. No. 78-14] G. No. 07-20] The fee for a construction permit shall be the sum of the subcode fees listed in Subsection A through L hereof and shall be paid before the permit is issued. A.. [Amended 1-26-81 by Ord. New construction: four cents ($0.04) per cubic foot of building or structure volume. The minimum fee shall be One Hundred dollars (100.00). [Amended 9-26-05 by Ord. No. 05-28; 6-25-07 by Ord. No. 07-20] (2)
Renovations, alterations and repairs: twenty five dollars ($25.00) per one thousand dollars ($1,000.) of estimated cost of the work, provided that the minimum fee shall be Fifty dollars ($50.). No. 07-20] Determining Estimate Costs - The applicant shall submit to the Division of Construction Inspection the estimate cost data produced by an Architect, Engineering, estimating firm or a bonafide contractor's bid price. The Division shall make the final decision regarding estimate cost. A copy of Contract to be provided. [Amended 6-25- 07 by Ord. No. 07-20] Fees based on cost per thousand shall include any part of a thousand. (3) Additions: Four cents ($.04) per cubic foot of building or structure volume for the added portion, provided that the minimum fee shall be One Hundred Dollars ($100.00). [Amended 9-26-05 by Ord. No. 05-28; 6-25-07 by Ord. No. 07-20] Fees based on a flat rate or cost per thousand shall be determined by the larger of the two amounts. (4) Combinations of renovations and additions: the sum of the fees computed separately as renovations and additions. Based upon the number of plumbing fixtures and plumbing stacks to be replaced or installed. The cost per fixture or stack shall be Twenty Dollars ($20.00) per unit, except as listed in Subsection B(2). [Amended 9-26-05 by Ord. No. 05-28; 6-25-07 by Ord. No. 07-20] (2) The fees for the installation of a grease trap, oil interceptor, water cool air conditioner and other special equipment or devices shall be One hundred fifty dollars ($150.00). Fees for the installation or replacement of a building sewer, septic systems or water service lines shall be based upon the number of fixtures to be serviced. The cost shall be Ten Dollars ($10.00) per fixture. There shall be a minimum fee of One Hundred Dollars ($100.00) for a sewer installation and One Hundred Dollars ($100.00) for water service installation. [Amended 4-11-94 by Ord. (6) For the purpose of computing fees, fixtures or stacks shall include, but not be limited to lavatories, kitchen sinks, slop sinks, sinks, urinals, water closets, bathtubs, shower stalls, laundry tubs, floor drains, drinking fountains, dishwashers, garbage disposals, clothes washers, hot-water heaters, dental chairs, air cooled air-conditioners, sump pumps and/or similar devices. No. 05-28] (a) Gas Boiler and Heater installation fee - Fifty Dollars ($50.00) or Fifteen Dollars ($15.00) per thousand of the estimated cost of construction for new or replacement installations except: Replacement of Residential R-5 boilers or heaters shall be Thirty Five ($35.00). There shall be a minimum charge for any plumbing subcode permit of Fifty Dollars ($50.00) or Twenty Five Dollars ($25.00) per Thousand of the plumbing cost. Residential R-5 Back Flow device fee shall be Thirty-Five Dollars ($35.00). The ELECTRICAL SUBCODE FEES shall be as follows: [Amended 8-24-92 by Ord. No. 92- 31; 4-11-94 by Ord. No. 94-20; 9-26-05 by Ord. No. 05-28; 6-25-07 by Ord. No. 07-20] (1) Receptacles and fixtures. (a) For from one (1) to twenty-five (25) receptacles or fixtures, the fee shall be in the amount of Sixty Five Dollars ($65.00). [Amended 9-26-05 by Ord. No. 05-28; 6- 25-07 by Ord. No. 07-20] (b) For each twenty-five (25) or portion thereof, receptacles or fixtures in addition to this, the fee shall be in the amount of Forty Dollars ($40.00). [Amended 9-26-05 by Ord. No. 07-20] (c) For the purpose of computing this fee, receptacles or fixtures shall include lighting outlets, wall switches, fluorescent fixtures, convenience receptacles or similar fixtures. (2) Motors and electric devices. [Amended 6-25-07 by Ord. No. 07-20] (a) For each motor or electric device of less than one (1) horsepower or one (1) kilowatt, the fee shall be in the amount of Twenty Dollars ($20.00). [Amended 9-26-05 by Ord. No. 07-20] (b) For each motor or device of from one (1) horsepower or one (1) kilowatt to five (5) horsepower or five (5) kilowatts, the fee shall be in the amount of Forty Five Dollars ($45.00). No. 07-20] (c) For each motor or device of greater than five (5) horsepower or five (5) kilowatts, the fee shall be in the amount of Forty Five Dollars ($45.00) plus Five Dollars ($5.00) for each increment of five (5) horsepower or five (5) kilowatts up to fifty (50) horsepower or fifty (50) kilowatts; and, thereafter, the fee shall be increased Five Dollars ($5.00) for each increment of ten (10) horsepower or ten (10) kilowatts. For the purpose of computing this fee, all motors shall be counted, including control equipment; generators, transformers and all heating; cooking or other devices consuming or generating electric current. (3)
Service panels or sub panels or Branch circuit feeders. [Amended 8-24-92 by Ord. No. 92-31; 9-26-05 by Ord. No. 05-28; 6-25-07 by Ord. No. 07-20] (a) For each service panel or sub panel of one hundred (100) amperes' capacity or less, the fee shall be in the amount of Seventy Five Dollars ($75.00). [Amended 9-26-05 by Ord. No. 07-20] (b) For each service panel or sub panel of greater than one hundred (100) amperes' capacity, the fee shall be: 101-200 AMPS Ninety Five Dollars ($95.00), 201-400 AMPS One Hundred Twenty Five Dollars ($125.00), 401-1000 AMPS Three Hundred Fifty Dollars ($350.00), Over 1000 AMPS Five Hundred Dollars ($500.00).
