& 135-60. Records. A. [Am ended 10-12-81 by Ord. No. 81-407] Each dealer shall record in a bound book, non-looseleaf form , with all pages num bered in sequence, entries of receipts and disbursem ents to be m ade in pen or ink. There shall be no space between entries and each entry shall be num bered in sequence. All such ledgers shall be m ade available for inspection by any law enforcem ent official of the Township of East Brunswick upon request and shall contain the following inform ation: (1) In the case of purchase: a. Identification used and num ber; such as driver's license, credit card. B. These records shall be retained by the dealer for a period of one (1) year and shall be subject to the inspection of any authorized police officer of the Township of East Brunswick. Each dealer shall retain within the Township all m erchandise in the form in which it was purchased for a period of at least seventy-two (72) hours. [Am ended 10-12-81 by Ord. No. 81-407]
B. No transaction m ay be m ade with any m inor as herein above defined. C. Each dealer m ust require two (2) form s of identification of the person with whom it is transacting business. & 135-62. Penalty. Any person as defined above who violates any provision of this Ordinance shall, upon conviction thereof, be punished by a fine not exceeding five hundred dollars ($500.00) or by im prisonm ent for a term not exceeding ninety (90) days, or both, within the discretion of the Municipal Judge. A separate offense shall be deem ed com m itted in each day during or on which a violation occurred or continues. ARTICLE IX Health Spas and Related Uses [Added 12-27-82 by Ord. No. 82-482] & 135-63. Definitions. [Amended 10-9-06 by Ord. No. 06-31] For the purpose of this Article, the following words and phrases shall have the m eanings respectively ascribed to them by this Section: a. Applicant. Person applying for a license under this ordinance and m ust include all partners including lim ited partners, of a partnership applicant, any officer or director of a corporate applicant, and any stockholder holding m ore than 2% of the stock of a corporation applicant. 13534

Any and all persons, including independent contractors, who render any services on behalf of a health spa or related use to custom ers or m em bers and who are paid directly either by the operator or the establishm ent or by the custom ers and m em bers. c. Health Spa. A place providing shower facilities and affording to its custom ers or m em bers facilities for physical exercise, including, but not lim ited to, swim m ing, dancing, body building, gym nastics, nautilus equipm ent or equivalent, jogging, aerobic dancing, slim nastics, steam room s, sauna, whirlpool, tanning and related uses, and/or any establishm ent providing m assage therapy, reflexology, acupressure, acupuncture that is not related to a m edical facility or doctor. [Am ended 10-9-06 by Ord. No. 06-31] d. Custom ers and Mem bers. A person who patronizes a health spa or related use and utilizes the services afforded on the prem ises by any em ployee or independent contractor under such circum stances that it is reasonably expected that he or she will pay m oney or give any other consideration therefor. e. Related Uses. This ordinance shall apply to owners and operators of any facilities offering any of the activities of a health spa, even if such related uses are part of a non-regulated facility, such as a tennis or racquetball club, a gym nasium or other use. & 135-64. Application for Licenses for Health Spas or Related Uses. [Amended 10-9-06 by Ord. No. 06-31] Any person desiring to own or operate a health spa or related use within the Township of East Brunswick shall file a written application with the Municipal Clerk to be filed by the owner and operator on a form to be furnished by the Municipal Clerk. The applicant shall pay an annual license fee of $200.00 and shall in addition furnish the following inform ation [Am ended 10-9-06 by Ord. No. 06-31]: a. W hether ownership of the business is by an individual, a partnership, a corporation or otherwise. b. The nam e, style and designation under which the business is to be conducted. c. The business address and all telephone num bers where the business is to be conducted. d. Nam e, com plete residence address and residence telephone num bers of Principals of applicant, m anager and Assistant Manager. e. The two previous addresses im m ediately prior to the present address of the applicant. f. Height, weight, color of hair and eyes, place and date of birth and Social Security num ber of principals of applicant, m anager and Assistant Manager, if any, of the prem ises. g. The business history and experience of the principals of the applicant, including but not lim ited to whether or not such person in previously operating a health spa has had a license or perm it denied, revoked or suspended and the reason therefor, and the business activities or occupations subsequent to such action of denial, suspension or revocation. h. All crim inal convictions of the principals of the applicant within seven (7) years prior to the filing of the application, other than traffic or disorderly persons violations, fully disclosing the jurisdiction in which convicted, and the offense for which applicant was convicted and the circum stances thereof. i. All inform ation required by & 135-1 through & 135-7 of the Code of the Township of East Brunswick. 13535

Authorization for the m unicipality, its agents and em ployees, to seek inform ation and conduct an investigation into the truth of the statem ents set forth in the application and the qualification of the applicant for the perm it. k. W ritten declaration by the applicant, under penalty of perjury, that the foregoing inform ation contained in the application is true and correct, said declaration being duly dated, signed and sworn to before a Notary Public or attorney of the State of New Jersey. & 135-65. Issuance or Denial of Health Spa License. The applicant shall be subject to the provisions of & 135-3 through & 135-7 of the Code of the Township of East Brunswick. The Director of Public Safety shall file his report with the Municipal Clerk within thirty (30) days of the filing of the application and the license shall be issued by the Municipal Clerk unless the investigation discloses one of the following: a. The applicant, a stockholder holding at least two (2% ) percent of the stock of the corporation, an officer or director of a corporation or any of the partners including lim ited partners or the m anager or other person principally in charge of the operation of the business have been convicted of any crim e involving dishonesty, fraud, deceit, sexual m isconduct, prostitution, soliciting for purposes of prostitution or any other crim e involving prostitution or any other crim es for which one of the principals has been convicted unless such conviction occurred m ore than seven (7) years prior to the date of the application. b. The applicant or any of its principals has knowingly m ade any false, m isleading or fraudulent statem ent of fact in the license application or in any docum ent required by the m unicipality in conjunction therewith. c. The applicant has had a m unicipal license or perm it for a sim ilar use denied, revoked or suspended for any of the above causes which action was not reversed by a court of com petent jurisdiction within seven (7) years prior to the filing of the application. & 135-66. Facilities Necessary. [Amended 10-9-06 by Ord. No. 06-31] No health spa or related use shall be issued a license nor shall the sam e be operated, established or m aintained in the Township of East Brunswick unless the facilities are m ade available for periodic inspection by representatives of the Departm ent of Public Safety, Departm ent of Health, Environm ent and W elfare and the Division of Construction Inspection to m ake certain that the prem ises are in conform ity with all m unicipal and state requirem ents. Am ong other things, the owners and operators of the prem ises m ust com ply with each of the following m inim um requirem ents: a. Tanning Room s, if any, shall be Underwriter Laboratory approved and com ply with all Federal and State requirem ents including, but not lim ited to, Food and Drug Adm inistration standards. b. Separate facilities for lockers, dressing, showers and m assages are to be provided so that m ale and fem ale custom ers or m em bers will not be in the changing or shower room s at the sam e tim e, subject to the right of the applicant to provide separate changing room s or use of such facilities on an alternating basis by m ale and fem ale custom ers or m em bers. 13536 9-07
& 135-66 LICENSES & 135-69 c. Areas shall be provided and used for the storage of clean linen, towels and other m aterials used in the operation of the health spa. All soiled linen, towels and other m aterials shall be kept in properly covered containers or cabinets separate from the clean storage area. d. All em ployees shall wear clean, non-transparent outer garm ents at all tim es. e. The sexual and genital area of custom ers and m em bers m ust be covered by towels, clothes or undergarm ents in the presence of an em ployee, m asseur, m asseuse or other patrons except in the shower area. f. No em ployee, m asseur or m asseuse shall perform any act in violation of the East Brunswick ordinances which prohibit sex clubs and m assage parlors. g. The owner and/or any m anager or em ployee m ay be held responsible for any prohibited act or violation of any state, federal, or m unicipal law or ordinance. [Added 10-9-06 by Ord. No. 06-31] & 135-67. Identification Card. [Amended 10-9-06 by Ord. No. 06-31] The Municipal Clerk shall provide each m asseur or m asseuse with an identification card at a cost of $100.00 each, which shall contain a photograph of the m asseur or m asseuse and which m ust be worn on the front of the outer-m ost garm ent at all tim es while on the prem ises during the hours of operation of any establishm ent granted a license pursuant to this article. [Am ended 10-9-06 by Ord. No. 06-31] Applications will be subm itted to the Municipal Clerk’s Office with attached docum entation of schooling or training in the field of m assage therapy, reflexology, acupressure, or acupuncture. The application will be forwarded to the Detective Bureau Identification Unit for verification of identity of applicant and authenticity of any attached docum entation. The ID card will be issued by the ID Unit and will expire one year from date of issuance. It will be the responsibility of the card holder to m ake application for a renewal and pay the $100.00 renewal fee. [Added 10-9-06 by Ord. No. 06-31] & 135-68. Transfer of Licenses. No license for the operation of a licensed prem ises issued pursuant to the provisions of this article shall be transferable except upon the filing of a new application with the Municipal Clerk and such transfer shall not be valid until the application for transfer is approved; provided, however, that upon the death or incapacity of the licensee, the health spa or related use m ay continue in business until the anniversary date of the license to allow for an orderly transfer of the license. & 135-69. Appeals to the Township Council. Any person affected by the findings and determ inations of the Township Clerk with regard to an application filed under this ordinance m ay appeal to the Township Council of the Township of East Brunswick, provided such appeal is filed within twenty (20) days after the date of such determ ination by the Township Clerk. The Township Council m ay extend the tim e within which to file an appeal by an additional thirty (30) days upon a showing of good cause. The Township Council shall conduct a hearing based upon the docum ents which have been filed and shall perm it oral argum ent and subm ission of written argum ent but shall entertain no new evidence at the tim e of the Council hearing. 13537 9-07
& 135-70 LICENSES & 135-70 & 135-70. Non-applicability of this Article. This article shall not apply to licensed hospitals, licensed nursing hom es or clinics or persons holding an unrevoked certificate to practice the healing arts under the laws of the State, or persons working under the direct supervision and in their presence, of any such persons or in any such establishm ents, nor shall this article apply to barbers or cosm etologists lawfully carrying out their particular profession or business and holding a valid, unrevoked license or certificate of registration issued by the State, nor to non-profit corporations, nor to governm ental entities.

& 135-71 EAST BRUNSWICK CODE & 135-73 ARTICLE X Bingo Licenses [Added 7-25-83 by Ord. No. 83-519] & 135-71. Restriction on Hours of Operation of Bingo Games Licensed by the Township of East Brunswick. All prem ises which are licensed to conduct bingo gam es within prem ises located in a residential zone shall be prohibited from conducting bingo gam es between the hours of 12 m idnight and 6:00 a.m ., Sunday night through Thursday night, inclusive. Bingo gam es m ay be conducted at such prem ises on Friday nights and Saturday nights during the hours indicated subject to specific approval by the Township Council but application for bingos on Friday night and Saturday night during the aforesaid hours m ay be denied by the Township Council upon a dem onstration of good cause by any interested person or persons. ARTICLE XI Amusement Licenses [Added 7-10-89 by Ord. No. 89-39] [Amended 7-8-91 by Ord. No. 91-74] & 135-72. Amusement Licenses For The Middlesex County Fair to non-profit organizations and associations. THIS SECTION OF CHAPTER 135, LICENSES, OF THE CODE OF THE TOW NSHIP OF EAST BRUNSW ICK, W AS REPEALED AND RESCINDED ON 7-8-91 BY ORD. NO. 91-74. ARTICLE XII CHRISTMAS TREES [Added 1-22-90 by Ord. No. 90-2] [Amended 9-25-91 by Ord. No. 91-96; 5-11-98 by Ord. No. 98-12] & 135-73. License Required. [Amended 5-11-98 by Ord. No. 98-12] A. No person shall engage in the outdoor seasonal sale of Christm as trees and/or Christm as decorations without having first obtained a license therefore from the Township Clerk, which license shall bear a num ber issued by the Township Clerk and which shall be prom inently displayed at the licensed prem ises. [Am ended 5-11-98 by Ord. No. 98-12] B. This ordinance shall not apply to businesses who offer for sale in their ordinary course of business, agricultural, horticultural or forestry produce or products as long as the sales occur on the sam e property as their regular business location. Such businesses shall be as further defined in 228-3 Definitions. [Added 5-11-98 by Ord. No. 98-12]
C. An application for a license m ust be filed by Novem ber 15, of the year in which said license shall take effect. Any license granted pursuant to this Article XII shall expire on Decem ber 31 of the year in which it is issued. [Added 5-11-98 by Ord. No. 98-12] 13538
4-99 & 135-74 EAST BRUNSWICK CODE & 135-76 & 135-74. Fee. [Amended 5-11-98 by Ord. No. 98-12] A. The fee for a Christm as tree sales license shall be $100.00 for the initial application and $100.00 for each annual renewal for each prem ises on which the regulated activity is to be conducted. [Am ended 5-11-98 by Ord. No. 98-12] B. Non-profit organizations shall be exem pt from &135-74A and &135-77, provided that said organizations subm it proof of their non-profit status with the application for a license from the Township Clerk. [Added 5-11-98 by Ord. No. 98-12] & 135-75. Location of Sale. [Amended 9-25-91 by Ord. No. 91-96; 5-11-98 by Ord. No. 98-12] The applicant shall present the Township Clerk with written perm ission from the property owner authorizing the sale of Christm as trees and Christm as decorations. The application shall set forth the proposed m ethod of clean up, a proposed lay out of the sales area, the location, intensity and direction of all outdoor lighting and a plan for parking and traffic safety. Accom panying the application shall be a certificate of liability insurance coverage form and am ount as directed by Director of Law for the protection of the general public. The Township Clerk shall subm it the application to 1) the Director of Public Safety, who shall determ ine the adequacy of parking and traffic safety, ingress and egress and fire protection standards, 2) the Zoning Officer, who shall determ ine lighting, buffering to protect nearby residences, and proper siting on a particular piece of property, and 3) the Chief Construction Official, who shall determ ine whether the appropriate construction perm its, including electrical perm its have been issued. If the application com plies with the determ inations m ade by the Director of Public Safety, the Zoning Officer, and the Chief Construction Official, the Township Clerk shall issue the license. & 135-76. Use of the Premises. [Amended 5-11-98 by Ord. No. 98-12] If the applicant proposes to locate a trailer on a prem ises, the trailer m ay be utilized only as an office and m ay not be occupied as living space. No hook-up to water or sewer is perm itted. The applicant shall obtain an electrical perm it if lighting is needed. Signs m ust be placed at least 10 feet from the right-of-way and m ay not be placed in the right-of-way. A m axim um of 2 signs is perm itted on the prem ises. No sign shall exceed 16 square feet in area. No separate sign perm it is required. & 135-77. Security. [Amended 5-11-98 by Ord. No. 98-12] The applicant shall file security in the am ount of $500.00 at the tim e that the application is filed, which security shall be returned by the Township Clerk when the prem ises are restored to their prior condition, as determ ined by the Code Enforcem ent/Zoning Officer. If the prem ises are not so restored within 3 days of the conclusion of the sale, excluding inclem ent weather not conducive to outdoor clean up, the Township of East Brunswick m ay use as m uch of the security as is necessary to restore the prem ises.
