A code defining and prohibiting certain m atters, things, conditions or acts, and each of them as a nuisance; prohibiting certain noises or sounds; requiring the proper heating of apartm ents; prohibiting lease or rental of certain buildings; prohibiting spitting in or upon public buildings, conveyances or sidewalks; authorizing the inspection of prem ises by an enforcing official; providing for the rem oval or abatem ent of certain nuisances and recovery of expenses incurred by the township in rem oving or abating such nuisances; and prescribing penalties for violation is hereby established pursuant to N.J.R.S. 26:3-69.1 et seq. A copy of said code is annexed hereto and m ade a part hereof without the inclusion of the text thereof herein.
The said code established and adopted by this Article is described and com m only known as the "Public Health Nuisance Code of New Jersey, (1953)."
Three (3) copies of the said Public Health Nuisance Code of New Jersey (1953) have been placed on file in the office of the Township Clerk upon the introduction of this Article and will rem ain on file there for the use and exam ination of the public. 15002 3-82

& 150-4 NUISANCES, PUBLIC HEALTH & 150-6 ARTICLE II Abandoned Wells and Test Holes [Adopted 2-10-69 as Ord. No. 69-14-C] & 150-4. Certain wells and test holes deemed a nuisance. The m aintenance of a well or test hole not in operation: around which no wall, fencing or sim ilar barrier has been erected to afford notice of the existence of such well or test hole; or in which there exists a present danger of pollution or contam ination; or which has rem ained inoperable for two (2) m onths without being sealed and filled with clean fill, is a nuisance.
A. No person shall apply or cause to be applied any pesticide from a helicopter or other airborne vehicle without first m aking suitable perm it application with the Director of Health and W elfare of the Township of East Brunswick. B. No perm it shall be issued until the Director of Health and W elfare is satisfied that the applicant has sufficient experience, facilities, equipm ent and proficiency to carry out properly such exterm ination with a m axim um degree of safety. C. No person shall apply pesticides in a m anner that causes or m ay tend to cause either unreasonable dam age to non-target areas or unreasonable harm and injury to persons. ARTICLE IV Transportation of Hazardous, Toxic and Chemical Waste [Adopted 3-24-80 by Ord. No. 80-225] & 150-6. Prohibition Against Illegal Transportation of Hazardous, Toxic and Chemical Wastes. No person shall operate a vehicle at any tim e upon the streets or roadways of the Township of East Brunswick if: a. Such vehicle is being used for the purpose of hauling or transporting solid waste; and b. Such waste m ay consist of hazardous toxic waste or chem ical waste as defined by the Regulations of the Bureau of Solid W aste Managem ent within the New Jersey Departm ent of Transportation; and c. If the operator of such a vehicle does not have proper docum entation indicating the contents of the vehicle, a perm it for the transportation of the waste and a perm it to dispose of the waste at a designated solid waste facility, all as required by the Regulations of the Bureau of Solid W aste Managem ent. 15003
3-82 & 150-7 EAST BRUNSWICK CODE & 150-10 & 150-7. Facilities Handling Hazardous and/or Toxic Material to Maintain a Recovery Drum on Premises. [Added 4-25-84 by Ord. No. 84-568] Any person or entity who owns or operates a com m ercial facility within the Township of East Brunswick which stores, m anufactures, m ixes, processes or in any way has in their possession any m aterial, including but not lim ited to flam m able, com bustible, corrosive poisonous or hazardous, as classified in accordance with 49 CFR of the Code of Federal Regulations, shall have at least one (l) recovery drum upon their prem ises. The drum will be m aintained and used for the sole purpose of control and containm ent of any of the aforem entioned m aterials in the event of a leak, spill or container failure. The recovery drum shall have the following m inim um standards of construction: 1. Have a m inim um capacity of 85 gallons (322 liters); 2. Overall height (over lock ring): 38-5/8" (98l MM); 3. Overall diam eter (over the roll loops): 26-7/8" (708 MM); 4. Cover, bottom and body structure: l6 ga. com m on grade carbon steel; 5. Exterior paint: Yellow with black stripes, im print "RECOVERY DRUM". & 150-8. Inspection and Enforcement. [Added 4-25-84 by Ord. No. 84-568] The provisions of & 150-7 shall be enforced by the Municipal Fire Inspectors. & 150-9. Penalty. [Added 3-24-80 by Ord. No. 80-225] Any person who violates any provision of this Article shall, upon conviction in the East Brunswick Municipal Court, be punished by a fine not to exceed five hundred ($500.00) dollars or im prisonm ent in the County Jail for a period not to exceed ninety (90) days or by both such fine and im prisonm ent, and each violation of any of the provisions contained in this Article and each day the sam e is violated, shall be deem ed and taken to be a separate and distinct offense. ARTICLE V The Costs of Removal to be Liens [Added 12-14-81 by Ord. No. 81-420] & 150-10. The Costs of Removal to be Liens. In the event that the Township of East Brunswick shall incur any costs due to the rem oval, containm ent, disposal, or other action taken by the Township of East Brunswick with regard to spills of hazardous, toxic, chem ical, or oil spills, such costs shall be certified by the Township Official in charge of such cleanup or rem oval to the Division of Revenue who shall bill the party responsible for the condition. If the bill is not paid within sixty (60) days, the Collector of Revenue shall m ake the costs a part of the taxes next assessed upon the prem ises where the condition was located, unless the party responsible for the condition is other than the owner of the property, in which case the Township shall be entitled to be reim bursed for all such costs by the party creating the aforesaid condition. 15004 3-82
