Consumer rights protection within eco-commerce

Abstract: The relevance of the article concerns the search for a single mechanism related to the protection of consumer rights in the Internet space, analysis and results of the work in our international and national legislation being carried out in this regard.

Today, within e-commerce, no single mechanism has been developed to protect consumer rights. It was during the period of COVID-19 that we witnessed this situation clearly. That is, during this period, consumers carried out their needs directly remotely. Nevertheless, there have been significant changes in e-commerce that have not been observed to this day, and in this regard, interest in the concept of e-commerce has intensified in the world.
By now, e-commerce has been regulated in a certain sense in the international arena and development trends are being realized. In this regard, many international and regional organizations are working to improve and develop e-commerce. A set of e-commerce rules "E-Terms" has been developed, and in the field of e-commerce, improved sections have been introduced.
The problem of relationships between sellers and buyers (consumers) on the Internet is the most pressing for the world community. If we look at the relevance of the chosen topic from a theoretical and practical angle, then it shows a new social sphere that is not fully legally regulated in the process of globalization. Within the United Nations, the e-commerce industry has certain consumer protection guidelines and guidelines.
The main laws governing consumer-related relationships are the Civil Code of the Republic of Uzbekistan. The first chapter of the Civil Code outlines the legal basis for civil treatment involving organizations and citizens (consumers). It covers legislation related to consumer protection, as well as regulatory legal acts with different legal levels, such as: the Consumer Protection Act and the Code of Administrative Responsibility of the Republic of Uzbekistan, the Criminal Code of the Republic of Uzbekistan. Republic of Uzbekistan. In case of significant violation of consumer rights, protection is provided by the norms of administrative and criminal law.
National law separates two groups of regulatory filings regulating consumer protection. The first group includes legislation providing for consumer rights, such as the Civil Code of the Republic of Uzbekistan, the Consumer Protection Act. These listed laws stipulate the basic rights of consumers to obtain quality goods (services, services), to ensure their safety for their lives and health, as well as to regulate the purchase, transportation, relationships associated with the contract, and their consequences.
The second group includes regulatory and legal acts aimed at regulating the relationships that arise in the field of e-commerce. The legislation of the Republic of Uzbekistan has adopted a number of regulatory acts "On e-commerce", "About Advertising", "On the conversion of electronic documents". In addition, in 2018, the President of the Republic of Uzbekistan adopted a resolution "On measures for the smooth development of e-commerce."
Legal regulation measures related to the circulation of goods through electronic commerce, which are directly related to civil rights, are not sufficient in international law and in our nationality. In practice, we will focus on some of the frequent cases associated with this situation and offer our own solutions in this regard.
1. The legal relationships resulting from e-commerce should not be regulated on the current territory. The problem with this issue is that access to social relationships without specifying applicable law creates a malnutritional conflict. As a solution to this, we consider it necessary to establish a territorial and legal relationship with consumer legal relationships that arise. The resulting rise in incomes could be an adaptation of the meltwater could be considered part of our "family". Each state also requires the development and strengthening of special provisions in its current legislation regulating issues related to consumer legal relationships.
2. Emerging problems with network marketing. In recent times, online stores have gained a lot of popularity, so they are interested not only in customers, but also in scammers. Today, there are many "one-day" online stores that take prepayment for goods and then disappear. In this regard, the customer is left without money and goods. The problem is that any individual can create a website to sell the goods, and this is still unregulated.
In conclusion, in a certain sense, it is only natural for an e-commerce industry to doubt that it is not ideal when it comes to cases of infection. However, it should be noted that it is a mistake to stop work in this regard, even if a citizen (consumer) remains inadequently protected from the consequences associated with e-commerce risks today. Because in the future, even if we are still pushing the developing industry back, it may also be a sufficient headache in some sense. From this soap, we must first create an effective system that ensures that consumer rights are properly protected, that these standards are adequately covered, and that we need to be able to implement it in practice.
