Forced sale value 4.10.7.1. Definition — A sum that could be obtained for the property where, for whatever reason, the seller is under constraints that require the disposal of the property in conditions that do not conform with the definition of Market Value. 4.10.7.2. Commentary — Forced sale value is a Market Value on a special assump- tion as to the conditions for marketing. The need for a valuation may arise 40 I.A. - EVS 1: Market Value European Valuation Standards 2020 where the seller is under compulsion to sell, is desperate to sell or a strict time limit is otherwise imposed. This might most obviously arise where the period in which the property is to be sold is too short to allow the proper marketing needed to be confident of the best bids. More generally, poten- tial buyers may be aware that the seller is under constraint and so mod- erate their bids from those they may otherwise have offered. The nature of these specific constraints determines the situation in which the hypo- thetical transfer takes place — without those constraints, it would simply be Market Value. 4.10.7.3. Further specific issues have been found in some markets with repos- sessed properties in the financial circumstances after 2008. The lender, now in possession, may either wish to dispose of the property promptly or be under some pressure to do so. Where the property is vacated by the former owner in good order, it might be that there are no further factors. Where it has been left in poor order, even without most fixtures and fit- tings, that will be evident on inspection and potentially relevant to the val- uation.
