For company driver with lease

Charge Back Items: Pursuant to Section XII of this Agreement, the following listed expenses, if initially paid for Independent Contractor by Carrier, shall be charged back and deducted from Independent Contractor’s compensation (or from Independent Contractor’s escrow account in the event that Independent Contractor’s compensation is insufficient): Any and all advances made to Independent Contractor, including but not limited to the following: Fuel and Milage Taxes Deductions; Accident Costs; Liability, Cargo, and Trailer/Interchange Insurance Premiums; Liability, Cargo, and Trailer/Interchange Insurance Premiums Claims; Trailer Lease; Non-Trucking Auto Liability; Other Insurance; Advances; Drug Screening; Fines; Tolls; and any other Advances. Independent Contractor is financially responsible for any losses or expenses incurred by Carrier because of its inability to collect freight charges earned due to Independent Contractor’s failure to properly complete and to submit paperwork and documents in a timely manner. 5. 
   TERMINATION
   

Subject to the provisions of Paragraph III, this Agreement may be terminated for any reason by giving a fourteen-days’ notice to that effect to the other party either personally, by e-mail, or by mail to designated phone number and addresses in Paragraph I.

6. Independent Contractor’s Responsibilities

Independent Contractor shall, during the term hereof perform transportation services and be available for dispatch and shall exercise all diligent efforts to conduct his or her operation to the satisfaction of Carrier and the applicable FMCSA rules and regulation. The Independent Contractor shall determine the means and method of the performance of all transportation services undertaken by the Independent Contractor under the terms of this Agreement.
