For company driver with lease

CARRIER HEREBY ADVISES CONTRACTOR THAT THE LAWS OF CERTAIN STATES MAY REQUIRE CONTRACTOR TO ACQUIRE AND MAINTAIN WORKERS' COMPENSATION INSURANCE.

8. 
   Accident Reports. Independent Contractor shall immediately report any accident involving operations under this Agreement to Carrier, including Independent Contractor’s written report of such accident. In the event Independent Contractor fails to notify Carrier of the accident within a reasonable amount of time of the accident's occurrence, Independent Contractor may be disqualified. Independent Contractor shall be liable for any and all damages resulting from that failure to notify, including but not limited to consequential damages, fines, claims by third parties and reasonable attorney fees. Furthermore, failure to report the accident may result in a penalty by the Carrier and termination of this Agreement.

   Social Security Taxes/ Unemployment Compensation. Independent Contractor understands and acknowledges that he/she assumes responsibility for payment
   

of estimated Social Security taxes and State and Federal income taxes.

7. Carrier’s Responsibilities

1. 
   Exclusive Possession and Responsibility. For liability purposes, Carrier shall assume complete responsibility for the operation of the Equipment throughout the duration of this Agreement. This subparagraph is set forth solely to conform to federal leasing regulations and shall not be used for any other purposes, including any attempt to classify Independent Contractor as an employee of Carrier.
