306.200COURT’SJURISDICTIONINMERGER

A United States District Court in New York held that it could not take jurisdiction over acase in which a local union sought to enjoin its international from forcing a merger on it in orderto derive the local of its autonomy. The local argued that, in effect, this action constituted theimpositionofa trusteeshipfor apurpose notallowable undersection 302.The courtrejected thisargument, and concluded that nothing in the legislative history of LMRDA indicates an intent toaffect mergers.
