4. Tow Away Zones: Any vehicle parked or standing as to obstruct or im pede a normal flow of traffic, block entrances or exit ways, loading zones, oil fills, any greasy area, pedestrian walkway, or present in any way a safety or traffic hazard may be rem oved by towing the vehicle at the owners expense.
The owners of the premises referred to in & 209-71 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4- 183.27. The cost of procurement and installation of the signs and pavement markings shall
be the responsibility of the owner of said property. The owner shall subsequently, to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Municipality. & 209-72 EAST BRUNSWICK CODE & 209-75 ARTICLE XVI TRAFFIC CONTROLS FOR STREETS, HIGHWAY CONSTRUCTION AND MAINTENANCE OPERATIONS [Added 3-22-99 by Ord. No. 99-17] & 209-72. Adoption of Manual on Uniform Traffic Control Devices for Streets and Highways. The Council hereby finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations. The Township of East Brunswick in the County of Middlesex, State of New Jersey, does hereby adopt the US DOT FHA current Manual on Uniform Traffic Control Devices, hereafter known as M.U.T.C.D. 1988 Edition, Revision 3, September 3, 1993 as amended and supplemented from time to time, except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.
It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility agreement, wishing to conduct work under the roadway or within the Right of Way of the roadway shall obtain the necessary permit from the planning and engineering department as outlined in Chapter 189 of this code.
It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility agreement, wishing to conduct work on, under or above the roadway to contact the Traffic Commander of the Township of East Brunswick, Department of Public Safety in order to schedule a pre-construction meeting to submit plans for safe movement of traffic during such period of construction of work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved is in violation of this section.
The person, contractor, or utility shall provide the Traffic Commander of the Department of Public Safety with at least two (2) emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Public Safety Department to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Township shall be charged to the person, contractor, or utility responsible for such conditions. 20980 7-99
& 209-76 VEHICLES & TRAFFIC & 209-79 & 209-76. Hours. There shall be no construction, maintenance operations, or utility work that would delay traffic or cause a safety hazard on any roadway in the Township before the hour of 9:00A.M. or after 4:00P.M. This time limit may be adjusted to permit work prior to 9:00A.M. or after 4:00P.M. if it is determined by the Township Engineer or his designee or Traffic Commander of the Department of Public Safety that said activities will not cause traffic delays or cause a safety or health hazard. & 209-77. Road Closing and Detours. Road closings and/or traffic detours shall not be permitted unless a detour plan is submitted and approved by the Township Engineer or his designee and the Traffic Commander of the Department of Public Safety. & 209-78. Traffic Directors. Traffic directors shall be posted at all construction or maintenance sites when determined by the Traffic Commander that same is necessary to provide for the safe and expeditious movement of traffic.
& 209-79. Stop Work. The Traffic Commander or his designee shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavation and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It shall be unlawful for any person to operate any motorized vehicle, including motorcycles, snowmobiles, minibikes, trail bikes, motor scooters, go-carts, motorized skateboards, all-terrain vehicles (ATV's) and dune buggies or any other vehicle in the class known as "recreational vehicles" on any property or under any circumstances described in & 212-2 hereof. B. It shall be unlawful for the owner of any motorized vehicle, as described in Subsection A hereof, to permit any person to operate said vehicles on any property or under any circumstances described in & 212-2 hereof. 21201 1-79
& 212-2 EAST BRUNSWICK CODE & 212-6 & 212-2. Property regulated. The property to be regulated by this chapter is as follows: A. All privately owned property and publicly owned property off the improved right-of-way, except driveways leading to and from the public right-of-way and residential right-of-way. & 212-3. Purpose. The Township Council hereby enacts this chapter because it finds that operation of such motorized vehicles has been conducted: A. In a manner so as to create loud, unnecessary or unusual noise so as to disturb or interfere with the peace, quiet and tranquility of others. B. In a careless, reckless or negligent manner so as to endanger or be likely to endanger the safety of others or the property of others. & 212-4. Exceptions. The terms and provisions of this chapter shall not be applicable to police or other emergency vehicles, including but not limited to ambulances, motorcycles, fire control vehicles and the like, or to motorized lawnmowers, tractors or farm vehicles or construction equipment. & 212-5. Confiscation. The Division of Police of the Department of Public Safety is hereby authorized to confiscate and impound any motorized vehicle which is allegedly operated in violation of the terms of this chapter.
Notwithstanding anything contained in this chapter to the contrary, application may be made to the East Brunswick Township Council to obtain a permit for a time period not exceeding three (3) months for the use of any vehicle regulated by this chapter on specific property. Notice of the application shall be served on all residents and owners of property within two hundred (200) feet of the subject property. The Council may issue a permit for the property if it finds that the proposed area shall be sufficient for the intended purpose, that adequate parking is available, that the means of ingress and egress are adequate to prevent traffic hazard, congestion or excessive interference with normal traffic movement on adjacent public streets and thoroughfares and that the property can be so used without adversely affecting the neighborhood. The permit shall be deemed to have been automatically renewed for additional periods of three (3) months each if no written complaint has been filed with the Township Clerk. If a written complaint has been filed with the Township Clerk, notice of same shall be served upon the holder of the permit and the permit shall expire at the end of the three-month period in questions unless a new application is filed and approved as set forth herein. 21202 1-79
