3. CONTAINER, PACKING
The Goods must be packed in bulk bags "Big-Bag". The weight of one bag should not exceed one ton.
Possible weight deviation +/-10% from one ton.
4. GOODS DELIVERY-ACCEPTANCE.
QUALITY OF THE GOODS
Goods' delivers-acceptance should be carried out in points and on the conditions, provided by present contract and according to operating order on transport. Sample selection and analysis of the Goods should be concluded by a technique, accepted in the Seller’s country.
The Goods are considered to be handed over at the point of departure:
by quantity in accordance with the weight and quantity specified in the waybill;
by quality in accordance with the certificate of quality.
By mutual agreement, upon shipment of the Goods, the Buyer has the right, at his own expense, to organize a check of the quality and quantity of the delivered Goods with the involvement of representatives of an independent inspection.
After the shipment of the Goods, the Seller informs the Buyer about the shipment of the Goods in writing by e-mail specified in this Contract, indicating the date of shipment, weight and number of the w waybill.
are not subject to claims in terms of quantity and quality.
The Seller transfers the following documents to the Buyer with the Goods:
certificate of origin of the Goods (ST-1);
certificate of compliance:
invoice;
waybill;
copy of GTD (Cargo Customs Declaration).
5. THE RESPONSIBILITY OF THE PARTIES
For untimely transfer of money to the currency account of Seller. Buyer pays fine at a rate of 0.1 % from unpaid amount per each day of delay, but not more than 5.0 % of the unpaid amount.
For untimely shipment of Goods to the Buyer, Seller pays fine at a rate of 0.1% for unshipped amount per each day. but not more than 5.0% of the unshipped amount.
For non-fulfillment or improper fulfillment of contractual obligations, the parties are liable in accordance with international norms, rules and the current legislation of the Republic of Uzbekistan.
The property right over the Goods realized on the basis of present contract, and risk of its casual destruction remains on Seller till the moment of transition of the property right over the Goods to Buyer on the terms of the delivery, specified in present contract.
