9-07 & 228-3 EAST BRUNSWICK CODE & 228-3 TRUCKING BUSINESSES, TERMINALS AND REPAIR SHOPS: Establishments furnishing local or long-distance trucking or transfer services. Also included are non-terminal facilities which specialize in truck maintenance, repair and service. Terminal facilities include land and buildings used as a relay station for the transfer of a load from one vehicle to another or one party to another. The boundaries of these districts are hereby established as shown on a map entitled "Zoning Map of the Township of East Brunswick", dated August 22, 1966, which accompanies and is hereby made a part of this chapter, except that any application for a m ajor subdivision which was classified as such by the Planning Board on or before October 4, 1966, shall be processed on the basis of the Zoning Map as it existed at the time the application was classified. B. The East Brunswick Township Council hereby adopts the Zoning Map for the Township of East Brunswick, dated July 1978, in accordance with a resolution of approval adopted by the East Brunswick Planning Board. A copy of the Official Zoning Map is on file in the Township Clerk's office. [Added 10-9-78 by Ord. No. 78-67] C. Adoption of Zoning Map. The P-1 (Planned Industrial Park) District as shown and described on the zoning map of the Township of East Brunswick, dated July, 1978, is hereby enlarged to include that general area bounded by Ryders Lane to the W est, Sawmill Brook to the North and the New Jersey Turnpike to the East, also known as Blocks 29.02 and 6.05, which is hereby rezoned to P-1 from R-3, notwithstanding the fact that the enlarged boundaries are not shown on the zoning map. The OP-1 (Office Professional) District as shown and described on the Zoning Map of the Township of East Brunswick dated July 1978 is hereby enlarged to include Lot 17.04, Block 319, which is hereby rezoned from P-1 to OP-1, notwithstanding the fact that the enlarged boundaries are not shown on the zoning map. on the Zoning Map of the Township of East Brunswick, dated July, 1978, is hereby enlarged to include Block 131, Lots 11.07, 11.08, 11.09, 12.04, a portion of 18.04 extending for a distance of 400 feet from the center line of Summerhill Road, and 18.05, which area is more particularly referred to on a map entitled "Proposed Expansion of OP-1 Zone" which was approved and adopted by the East Brunswick Planning Board on August 6, 1980, and all of which is hereby rezoned to OP-1 from R-2 and C-4, notwithstanding the fact that the enlarged boundaries are not shown on the zoning map. The C-5 Business Zone (Shopping Center) as shown and described on the Zoning Map of the Township of East Brunswick dated July 1978 is hereby enlarged to include Blocks 89.06, 101 and 101.01, Block 89, Lots 4.26, 4.27, 4.28 and 4.29, which plans are m ore particularly referred to in a resolution adopted by the East Brunswick Planning Board on December 17, 1980 which incorporated a map 22834 10-10 Editor's Note: A copy of the Zoning Map is on file in the office of the Township Clerk. The R-3 Single Family Residence District and Zone as shown and described on the Zoning Map of the Township of East Brunswick, dated July, 1978, is hereby enlarged to include that general area bounded on the W est by the westerly line of a newly created lot consisting of 2.44 acres from Lot 25, Block 6.05, on the Northwest by the northwest block line of Block 6.05, on the North by Sawmill Brook, on the East by the New Jersey Turnpike, and on the South by Tices Lane up to the W esterly line of the newly created lot, which property is hereby rezoned from P-1 to R-3, notwithstanding the fact that the enlarged boundaries are not shown on the Zoning Map. The OP-1 (Office Professional) Zone as shown and described on the Zoning Map of the Township of East Brunswick dated July, 1978 is hereby enlarged to include all that area previously zoned, VG-II (Village Green), R-2 (Single Family Suburban Residence) between the existing zone line and the center line of relocated Ryders Lane between Summerhill Road and Rues Lane, all as more particularly shown on a m ap annexed hereto as Schedule A and as more particularly described in a metes and bounds description annexed as Schedule B. The MMH (Modular Manufactured Housing and Mobile Manufactured Housing) Zone is hereby created to include all that area previously zoned R-1 (Single Family Rural Residence) bounded by Helmetta Boulevard on the northeast, Cranbury Road on the northwest, the municipal boundary between the Township of East Brunswick and the Township of Monroe on the southwest, and as more particularly described in the metes and bounds description annexed hereto as Schedule A. The Zoning Map of the Township of East Brunswick shall be deemed to have been changed in accordance with this Ordinance notwithstanding the fact that the MMH Zone is not shown thereon. & 228-5 ZONING & 228-5 S. Adoption of Zoning Map. The R-1 (Single Family Rural Residence) Zone as shown and described on the Zoning Map of the Township of East Brunswick dated July, 1978 and as more particularly described on Schedule A annexed hereto is hereby amended to include a VG II (Village Green II) option. The Zoning Map of the Township of East Brunswick shall be deemed to have been changed in accordance with this Ordinance notwithstanding the fact that the enlarged boundaries for the Village Green II Option Zone are not shown thereon. This amendment is being made pursuant to a settlement of litigation against the Township of East Brunswick. [Added 7-9-84 by Ord. No. 84-584] T. [Added 7-9-84 by Ord. No. 84-586] (See & 228-285C) Adoption of Zoning Map. The I/M (Industrial/Manufacturing) Zone as shown and described on the Zoning Map of the Township of East Brunswick dated July, 1978 and as more particularly shown on Schedule A annexed hereto is hereby am ended to include a Village Green II (VG II) Option Zone subject to the following: (a) The zoning change will not become effective until all active mining in the Zone has ceased, as certified to by the Township of East Brunswick or until December 31, 1989, but in no event later than December 31, 1989. The Township Engineer shall annually inspect the subject property and shall report to the Township Council upon receiving a report that active mining has ceased, the Township Council shall forthwith certify by ordinance the effective date of the change of zoning set forth herein. The Zoning Map of the Township of East Brunswick shall be deemed to have been changed in accordance with this Ordinance to provide the VG II Option in the subject property with a notation that the Township shall have the responsibility of determining when active mining has ceased. (b) No part of the tract described on Schedule A annexed hereto may be developed to Village Green II standards until the Township has certified that all active mining has ceased throughout the tract, or until December 31, 1989, whichever is sooner. (c) This amendment is being made pursuant to a settlement of litigation against the Township of East Brunswick. U. Adoption of Zoning Map. There is hereby created an MXD/R (Mixed Use Development/Residential) Zone as more particularly described on the metes and bounds description annexed hereto as Schedule A and covering the tract known as W eingarten-Turnpike Drive-In as an Option Zone for the existing O-l (Office), Professional and Apartment District and C-3, General Commercial District. The Zoning Map of the Township of East Brunswick shall be deemed to have been changed in accordance with this Ordinance notwithstanding the fact that the enlarged boundaries for the MXD/R (Mixed Use Development/Residential) Zone are not shown thereon. This amendment is being made pursuant to a settlement of litigation against the Township of East Brunswick. (See & 228-287A, B) [Added 7-9-84 by Ord. No. 84-585] V. [Added 7-9-84 by Ord.
