Legal Eagle - Ultimate Pre-Law Checklist 4.0

1. UNDERSTAND THE END GAME
Because of the fact-intensive issue-spotting nature of these tests, if you miss the issues
you will miss those points on the exam. If you misconstrue or misunderstand the facts
you’ll get the analysis wrong.
The analysis is not like “analysis” in college. It’s all about applying legal concepts to
situations you’ve never seen before. As an undergrad, your professor might have asked
you to “explain the history of the automobile” on an exam.
In Law School, it’s more like your professor is going to give you a box of parts, and ask
you to build a car from scratch. Then, your professor is going ask you to race whatever
you build against every other student in the class.
ISEs are intense. Most law students think writing an ISE answer is a dark art. In reality,
they can be hacked. It’s a skill that can be learned.

1. UNDERSTAND THE END GAME
D. Understand that Law School is taught using the “Case Method”
Law School is taught using the “Case Method.”
Students are required to read case after case.
Each case is used to demonstrate a particular idea or law, but it’s almost always
obliquely and indirectly. Rarely will the case state the legal rule explicitly.
Most homework in Law School consists of reading cases.
There are no text books in Law School. Rather, there are compilations of cases in
“casebooks.”

1. UNDERSTAND THE END GAME
E. Understand that classroom discussions will be based on the dreaded ‘Socratic Method’
Classes are also conducted in an unusual way: the Socratic Method.
Named after the greek philosopher, the Socratic Method general consists of the professor
inviting a student provide a summary case assigned for that day's class.
The student is then grilled on details overlooked or issues unresolved.
A professor will often manipulate the facts of the actual case at hand into a hypothetical
case that may or may not have demanded a different decision by the court.
As you can imagine, being on the hot seat, facing a professor’s questions can be nerve
wracking.
