200.670WHENVIOLATIONOCCURS


A false entry, willfully made, constitutes a violation of section 209(c) of the Act.Consequently, any person who willfully makes a false entry in any of the records "required to bekept by the provisions of this title" is liable within the meaning of the Act, regardless of whetheror not said person signs reports. Because a false entry constitutes a violation it is not necessarythat such false entry be made with the intent to report to the Department. It follows that theviolationoccursatthetimeof entry, as opposed tothe time the report issubmitted.


200.680LEDGERACCOUNTS


Prior to an election the incumbent president and secretary-treasurer issued quarterly work cardsto certain members without charge in order to induce the recipients thereof to vote for them. Theindividual ledger accounts of those members who received the work cards fraudulently reflectedthepayment of quarterly dues.


Where the ledger accounts show dues payments by the individual members who received workcards when, in fact, said members made no dues payments and none were made in their behalf, afalsificationofrecordswithinthepurviewofsection209(c)hasoccurred.


LABORORGANIZATIONINFORMATIONREPORTINGENERAL





    1. LMRDA,SECTION201(a)

Every labor organization shall adopt a constitution and bylaws and shall file a copy thereofwith the Secretary, together with a report, signed by its president and secretary or correspondingprincipalofficers,containing the following information--



      1. the name of the labor organization, its mailing address, and any other address at which itmaintainsitsprincipaloffice or atwhich itkeeps the recordsreferred to inthis title;

      2. thename and titleofeach ofitsofficers;

      3. the initiation fee or fees required from a new or transferred member and fees for workpermitsrequiredbythereportinglabororganization;

      4. the regular dues or fees or other periodic payments required to remain a member of thereportinglabor organization;and

      5. detailed statements, or references to specific provisions of documents filed under thissubsection which contain such statements, showing the provision made and procedures followedwith respect to each of the following: (A) qualifications for or restrictions on membership, (B)levying of assessments, (C) participation in insurance or other benefit plans, (D) authorizationfor disbursement of funds of the labor organization, (E) audit of financial transactions of thelabor organization, (F) the calling of regular and special meetings, (G) the selection of officersand stewards and of any representatives to other bodies composed of labor organizations'representatives, with a specific statement of the manner in which each officer was elected,appointed, or otherwise selected, (H) discipline or removal of officers or agents for breaches oftheir trust, (I) imposition of fines, suspensions, and expulsions of members, including thegrounds for such action and any provision made for notice, hearing, judgment on the evidence,and appeal procedures, (J) authorization for bargaining demands, (K) ratification of contractterms, (L) authorization for strikes, and (M) issuance of work permits. Any change in theinformation required by this subsection shall be reported to the Secretary at the time thereporting labor organization files with the Secretary the annual financial report required bysubsection(b).
