N GENERAL
.—The Secretary, in consultation
1
with representatives of appropriate Federal and State
2
agencies, shall—
3
(A) conduct a study of—
4
(i) the location and extent of antici-
5
pated growth of natural gas and other en-
6
ergy transmission infrastructure proposed
7
to be constructed across the Great Lakes;
8
and
9
(ii) the environmental impacts of any
10
natural gas or other energy transmission
11
infrastructure proposed to be constructed
12
across the Great Lakes; and
13
(B) make recommendations for minimizing
14
the environmental impact of pipelines and other
15
energy transmission infrastructure on the Great
16
Lakes ecosystem.

(2) A

OMMITTEE
.—Not later than 30
18
days after the date of enactment of this Act, the Sec-
19
retary shall enter into an agreement with the Na-
20
tional Academy of Sciences to establish an advisory
21
committee to ensure that the study is complete, objec-
22
tive, and of good quality.

(c) R
EPORT
.—Not later than 1 year after the date of
24
enactment of this Act, the Secretary shall submit to Con-
25

gress a report that describes the findings and recommenda-

tions resulting from the study under subsection (b).

SEC. 1707. NATIONAL ACADEMY OF SCIENCES STUDY OF

PROCEDURES FOR SELECTION AND ASSESS-

MENT OF CERTAIN ROUTES FOR SHIPMENT
5
OF SPENT NUCLEAR FUEL FROM RESEARCH

NUCLEAR REACTORS.

ENERAL
.—The Secretary of Transportation
8
shall enter into an agreement with the National Academy
9
of Sciences under which agreement the National Academy
10
of Sciences shall conduct a study of the procedures by which
11
the Department of Energy, together with the Department
12
of Transportation and the Nuclear Regulatory Commission,
13
selects routes for the shipment of spent nuclear fuel from
14
research nuclear reactors between or among existing De-
15
partment of Energy facilities currently licensed to accept
16
such spent nuclear fuel.
17
(b) E
LEMENTS OF
S
TUDY
.—In conducting the study
18
under subsection (a), the National Academy of Sciences
19
shall analyze the manner in which the Department of
20
Energy—
21
(1) selects potential routes for the shipment of
22
spent nuclear fuel from research nuclear reactors be-
23
tween or among existing Department facilities cur-
24
rently licensed to accept such spent nuclear fuel;

(2) selects such a route for a specific shipment of

such spent nuclear fuel; and
2
(3) conducts assessments of the risks associated
3
with shipments of such spent nuclear fuel along such
4
a route.

.—The analysis under subsection (b) shall include a

consideration whether, and to what extent, the procedures
8
analyzed for purposes of that subsection take into account
9
the following:

(1) The proximity of the routes under consider-
11
ation to major population centers and the risks asso-
12
ciated with shipments of spent nuclear fuel from re-
13
search nuclear reactors through densely populated
14
areas.
15
(2) Current traffic and accident data with re-
16
spect to the routes under consideration.
17
(3) The quality of the roads comprising the
18
routes under consideration.
19
(4) Emergency response capabilities along the
20
routes under consideration.
21
(5) The proximity of the routes under consider-
22
ation to places or venues (including sports stadiums,
23
convention centers, concert halls and theaters, and
24
other venues) where large numbers of people gather.

ECOMMENDATIONS
.—In conducting the study

under subsection (a), the National Academy of Sciences
2
shall also make such recommendations regarding the mat-
3
ters studied as the National Academy of Sciences considers
4
appropriate.

.—The Secretary shall disperse to the National Acad-

emy of Sciences the funds for the cost of the study required

6 months after the date of the dispersal of funds under sub-
12
section (e), the National Academy of Sciences shall submit
13
to the appropriate committees of Congress a report on the

study conducted under subsection (a), including the rec-

ommendations required by subsection (d).

SEC. 1708. REPORT ON ENERGY SAVINGS AND WATER USE.

(a) R
EPORT
.—The Secretary of Energy shall conduct
2
a study of opportunities to reduce energy use by cost-effec-
3
tive improvements in the efficiency of municipal water and
4
wastewater treatment and use, including water pumps, mo-
5
tors, and delivery systems; purification, conveyance and
6
distribution; upgrading of aging water infrastructure, and
7
improved methods for leakage monitoring, measuring, and
8
reporting; and public education.
9
(b) S
UBMISSION OF
R
EPORT
.—The Secretary of En-
10
ergy shall submit a report on the results of the study, in-
11
cluding any recommendations for implementation of meas-
12
ures and estimates of costs and resource savings, no later
13
than 2 years from the date of enactment of this section.
14
(c) A
UTHORIZATION
.—There is hereby authorized to be
15
appropriated such sums as may be necessary to carry out
16
the purposes of this section.
17
SEC. 1709. REPORT ON RESEARCH ON HYDROGEN PRODUC-
18
TION AND USE.
19
Not later than 120 days after the date of enactment
20
of this Act, the Secretary of Energy shall submit to Congress
21
a report that identifies current or potential research
22
projects at Department of Energy nuclear facilities relating
23
to the production or use of hydrogen in fuel cell development
24
or any other method or process enhancing alternative en-
25
ergy production technologies.

.—

(A) I
N GENERAL
.—The term ‘‘critical en-

ergy infrastructure’’ means a physical or cyber-
11
based system or service for—
12
(i) the generation, transmission or dis-
13
tribution of electric energy; or
14
(ii) the production, refining, or storage
15
of petroleum, natural gas, or petroleum
16
product—
17
the incapacity or destruction of which would
18
have a debilitating impact on the defense or eco-
19
nomic security of the United States.
20
(B) E
XCLUSION
.—The term shall not in-
21
clude a facility that is licensed by the Nuclear
22
Regulatory Commission under section 103 or
23
104b. of the Atomic Energy Act of 1954 (42
24
U.S.C. 2133 and 2134(b)).

SEC. 1802. ROLE OF THE DEPARTMENT OF ENERGY.

Section 102 of the Department of Energy Organization
6
Act (42 U.S.C. 7112) is amended by adding at the end the
7
following:
8
‘‘(20) To ensure the safety, reliability, and secu-
9
rity of the Nation’s energy infrastructure, and to re-
10
spond to any threat to or disruption of such infra-
11
structure, through activities including—
12
‘‘(A) research and development;
13
‘‘(B) financial assistance, technical assist-
14
ance, and cooperative activities with States, in-
15
dustry, and other interested parties; and
16
‘‘(C) education and public outreach activi-
17
ties.’’.

SEC. 1803. CRITICAL ENERGY INFRASTRUCTURE PRO-
19
GRAMS.
20
(a) P
ROGRAMS
.—In addition to the authorities other-
21
wise provided by law (including section 1261), the Sec-
22
retary is authorized to establish programs of financial, tech-
23
nical, or administrative assistance to—

(1) enhance the security of critical energy infra-
1
structure in the United States;
2
(2) develop and disseminate, in cooperation with
3
industry, best practices for critical energy infrastruc-
4
ture assurance; and
5
(3) protect against, mitigate the effect of, and
6
improve the ability to recover from disruptive inci-
7
dents affecting critical energy infrastructure.
8
(b) R
EQUIREMENTS
.—A program established under
9
this section shall—
10
(1) be undertaken in consultation with the advi-
11
sory committee established under section 1804;
12
(2) have available to it the scientific and tech-
13
nical resources of the Department, including resources
14
at a National Laboratory; and
15
(3) be consistent with any overall Federal plan
16
for national infrastructure security developed by the
17
President or his designee.
18
SEC. 1804. ADVISORY COMMITTEE ON ENERGY INFRA-
19
STRUCTURE SECURITY.
20
(a) E
STABLISHMENT
.—The Secretary shall establish
21
an advisory committee, or utilize an existing advisory com-
22
mittee within the Department, to advise the Secretary on
23
policies and programs related to the security of United
24
States energy infrastructure.

EMBERSHIP
.—The Secretary shall en-
1
sure that the advisory committee established or utilized
2
under subsection (a) has a membership with an appropriate
3
balance among the various interests related to energy infra-
4
structure security, including—

(1) scientific and technical experts;
6
(2) industrial managers;
7
(3) worker representatives;
8
(4) insurance companies or organizations;
9
(5) environmental organizations;
10
(6) representatives of State, local, and tribal gov-
11
ernments; and
12
(7) such other interests as the Secretary may
13
deem appropriate.

(c) E
XPENSES
.—Members of the advisory committee
15
established or utilized under subsection (a) shall serve with-
16
out compensation, and shall be allowed travel expenses, in-
17
cluding per diem in lieu of subsistence, at rates authorized
18
for an employee of an agency under subchapter I of chapter
19
57 of title 5, United States Code, while away from the home
20
or regular place of business of the member in the perform-
21
ance of the duties of the committee.

The Secretary, in consultation with the advisory com-

rangements with one or more standard-setting organiza-

tions, or similar organizations, to assist the development

to protecting critical energy infrastructure.

.—The term ‘‘distance’’ means the

minimum great circle distance, measured in statute
11
miles.

N GENERAL
.—The term ‘‘leased tract’’

means a tract that—

(i) is subject to a lease under section 6
16
or 8 of the Outer Continental Shelf Lands
17
Act (43 U.S.C. 1335, 1337) for the purpose

of drilling for, developing, and producing

oil or natural gas resources; and
