9.5. Basic provisions for searching for wagons (cargo)
9.5.1. Establishing ownership without a documented carriage (cargo). 9.5.1.1. The search for wagons (cargo) is carried out by the station’s cargo search agent , who, in addition, is assigned the following responsibilities: - registration of commercial acts drawn up at the station; - preparing materials for the station manager to investigate cases of unsafe cargo according to commercial acts and operational reports; - maintaining records and reporting on the investigative case; - analysis of transportation safety. 9.5.1.2. If a wagon without documents is discovered, the station is obliged to draw up a commercial act, record this in the book without documented wagons of the GNU-1 form, take measures to establish the ownership of the cargo (wagon, container, small shipment) and notify about the found cargo by telephone: - the formation station of the train in which the loaded car arrived without a document, and the station indicated on the control form of the DU-81 form, if it does not correspond to the train formation station. If there are seals on the car, the telegram is also addressed to the station whose seals are affixed to the car; - the station that applied the seals to the car, and the departure station according to the railway markings; - the station that compiled the wagon list for the cargo that arrived on open rolling stock or in a wagon without seals; - a group for centralized cargo search in all cases of detection of wagons without documents if they have railway markings. 9.5.1.3. The station that receives such a message carefully checks the presence of documents and reports the results of the check to the station that made the request and to the destination station, if ownership is established. In the case where only the departure station is identified, the station that discovered the undocumented cargo is obliged to inquire about the identity of the cargo. The departure station determines whether the cargo belongs to the shipment according to the Cargo Reception Book or other documents and informs the station that made the request and the cargo destination station about this within 24 hours. Search telegrams indicate the date and circumstances under which the carriage was found without documents, its number, type of cargo, information about seals. 9.5.1.4. If, despite the measures taken, the ownership of a non-documented wagon is not established, it is necessary to open the wagon and check whether there are any documents or other data inside it indicating where the cargo is coming from and where it is going. The opening of the car, as well as its sealing after inspection, is carried out by the acceptance and delivery officer in the presence of the station manager (his deputy) or the head of the freight yard. The result of the autopsy is entered into sections E and G of the commercial act. If it is suspected that there is perishable cargo, the carriage is opened immediately. 9.5.1.5. When establishing the identity of the cargo, the station that has discovered an undocumented carriage sends it to the destination station using forwarding documents, to which a commercial act (second copy) is attached, and at the same time notifies the destination station, the station that allowed the carriage to be sent, about this. 9.5.1.6. If the measures taken do not allow establishing a route without a documented carriage, the cargo, with the permission of the head of the road freight service, is transferred in the established manner and within the established time frame to other organizations. 9.5.1.7. To establish ownership without a documented own car that does not have a registration stencil, you must contact the Main Transportation Directorate, indicating the car number. 9.5.2. Transportation documents found without cargo. 9.5.2.1. A station that discovers transportation documents without a carriage is obliged to check whether there is a carriage on the station tracks or repair tracks. If the car is not detected, the station: - draws up a commercial act, and sends the second copy, along with documents for the car, by mail to the destination station; - reports the incident to the train formation station and the car departure station. 9.5.2.2. Transportation documents are sent by registered mail with a list of all names and numbers included in the package of documents. An inscription is made on the package (transportation documents). The package with such documents is registered in a special book and stamped with the stamp of the station sending the documents. 9.5.2.3. The destination station, having received the specified documents, checks whether the carriage has arrived according to the forwarding document, and whether search correspondence has been received regarding this cargo. If it is determined that the cargo has not arrived at the destination station, then the station responsible under the commercial act for the loss or misdirection of the cargo requests the results of the search and the search is organized in accordance with paragraph 7-15 of the Instructions for searching for cargo on railways. 9.5.2.4. The destination station, which has a transportation document without a wagon (cargo), carries it out according to the FO-5 form issuance report, if the cargo has not been delivered and its location has not been established after 30 days from the date of expiration of the delivery period, and for direct transportation, mixed rail and water transport - after 4 months from the date of acceptance of the cargo for transportation. If, as a result of the search, it is established that the cargo was issued at another station or lost in transit, the documents are carried out according to the release report upon receipt of a message about this. A corresponding note about the loss or delivery of cargo is made in the road manifest. Transportation documents for cargo completely lost due to a wreck, accident, etc. are carried out according to the release report (form FO-5) by the station at which the loss of the cargo occurred. In these cases, a commercial act with a note about the loss of cargo is attached to the delivery report along with transportation documents. 9.5.2.5. The station at which the cargo was lost or sold sends a telegram about this to the destination station. If the cargo is lost or transferred (sold) along the route, the station is obliged to send the destination road administration a copy of the commercial act and the act of transfer of the cargo.
