& 49-6. Performance guaranty. [Amended 10-23-78 by Ord. No. 78-75] To further ensure conform ity with the provisions of this chapter in respect to new subdivisions for the purpose of a housing developm ent, the Planning Board of the Township of East Brunswick m ay, at its discretion, require an affidavit or a perform ance guaranty, approved as to form by the Township Attorney, that the subdivision will be developed so that the intent and purpose of this chapter is satisfied. The Chief Construction Official is also hereby authorized to require a sim ilar affidavit or perform ance bond before issuance of m ore than one (1) building perm it in any housing developm ent or part thereof for any subdivision heretofore approved by the Planning Board prior to the enactm ent of this chapter or for any land area not required to be subdivided.
Appeals from any decision of the Chief Construction Official under the provisions of this chapter shall be taken to the Construction Board of Appeals, and relief m ay be granted by the Construction Board of Appeals when, in his opinion, such relief is not detrim ental to the public interest. The Construction Board of Appeals shall schedule a hearing on the appeal within the tim e perm itted by the Rules governing the Construction Board of Appeals after receiving written notice thereof, and it shall return its decision within ten (10) days after com pletion of the hearing. The Construction Board of Appeals m ay convene the Advisory Building Safety Com m ittee for the purpose of soliciting their advice, but the opinion of the Com m ittee shall only be advisory.
Any owner or lessee or other person or persons who perm its, takes part or assists in any violation of any provision of this chapter shall, upon conviction, for each and every violation thereof and for each and every day that such violation thereof continues, be subject to the penalties provided for in Chapter 1, General Provisions, Article I. 4903
3-82 & 51-1 ARMED SECURITY OFFICERS & 51-3 CHAPTER 51 ARMED SECURITY OFFICERS & 51-1. Intent. & 51-2. Definitions. & 51-3. Identification; Authority; Location & Description of Duties; Duties. & 51-4 Penalty. [History: Adopted by the Township Council of the Township of East Brunswick on 3-28-88 as Ord. No. 88-914. Amendments noted where applicable.] & 51-1. Intent. Extensive com m ercial developm ent within the Township has created a dem and for services of arm ed security officers stationed in various locations throughout the Township. The prim ary intent of this ordinance is to prevent an accidental shooting situation involving an arm ed security officer and m em bers of the East Brunswick Police Departm ent. Requirem ents include properly identifying the security officer, the officer's authority and location and description of duties. & 51-2. Definitions. Arm ed Security Officer is any person authorized by law to carry a firearm within the State of New Jersey, including licensed private investigators and their authorized em ployees or Municipal, County, State and Federal Law Enforcem ent officers being paid by a com m ercial establishm ent to perform a security function while arm ed. East Brunswick Police Officers are exem pt from this ordinance. & 51-3. Indentification; Authority; Location & Description of Duties; Duties. A.
Indentification. T he arm ed security officer will com plete an application for a photographic identification card. Applications are available at the East Brunswick Departm ent of Public Safety. One card will be issued to the security officer, while copies of the officer's photograph are retained in file and dissem inated to East Brunswick Police Officers. B. Authority. W ritten docum entation of authority shall be furnished with the security officer's application for a photographic identification card. 1. Licensed Private Investigators shall furnish a copy of a valid Private Investigators License. 2. Law Enforcem ent Officers shall furnish a copy of their agency issued identifications in addition to written docum entation from their Chief/Director Prosecutor specifically stating that the officer has been granted authorization to accept private security em ploym ent, while arm ed, within the Township of East Brunswick. C. Location and Description of Duties. The location of the em ploying com m ercial establishm ent shall be furnished, including com plete identification of the person or persons seeking to em ploy the arm ed security officer. 5101 9-88
& 51-3 EAST BRUNSWICK CODE & 51-4 D. Duties. The duties of an arm ed security officer shall be identified in the application, including, but not lim ited to, the following: 1. Range of hours to be worked. 2. W hether working at a fixed post, including exact location, or a transitory location. 3. Param eters of responsibility including the following: a. Cash flow control. b. Escots to bank. c. Em ployee internal investigations. d. Shoplifter detection. e. Inventory control. f. Other. & 51-4. Penalty. Any person as defined herein who violates any provision of this ordinance shall, upon conviction thereof, be punished by a fine not exceeding five hundred dollars ($500.00) or by im prisonm ent for a term not exceeding ninety (90) days, or both, within the discretion of the Municipal Judge. No barbershop shall be open for business earlier than 8:30 a.m . or rem ain open after 6:00 p.m ., except on Saturdays and the days preceding the holidays listed below, when they shall close no later than 7:00 p.m . & 58-1 EAST BRUNSWICK CODE & 58-7 & 58-1. Purpose. The intent of this chapter is to encourage the safe and proper operation of bicycles on the streets of the Township of East Brunswick, particularly by children; to further the program s established by the township police, schools and civic groups to train children in the safe operation of bicycles; and to provide a m eans of identifying the owners of bicycles and violators of this chapter and other statutes and ordinances governing the operation of bicycles. & 58-2. Definitions. [Amended 10-12-76 by Ord. No. 76-262; 4-9-84 by Ord. No. 84-565] As used in this chapter, the following term s shall have the m eanings indicated: BICYCLE - Any two-or three-wheeled vehicle having a rear drive which is solely hum an powered and having a seat height of twenty-five (25) inches, or greater, when the seat is in the lowest adjustable position.
No bicycle shall be operated within the Township of East Brunswick unless it has been registered and bears a registration tag.
Applications for the registration of a bicycle shall be m ade to the East Brunswick Departm ent of Public Safety, on a form approved by the Director of Public Safety, and shall contain the following inform ation: A. The nam e and address of the bicycle owner. B. A description of the bicycle, including the nam e of the m anufacturer and the serial num ber, if any. C. Any other appropriate inform ation which the Director of Public Safety m ay require. & 58-5. Inspection prior to issuance of registration. [Amended 10-12-76 by Ord. No. 76-262; 4-9-84 by Ord. No. 84-565] Before a registration is issued, the bicycle for which it is intended shall be inspected by a m em ber of the Departm ent of Public Safety designated by the Director of Public Safety. No registration shall be issued for a bicycle which is in a state of disrepair or which has any m echanical defect or which would for any other reason be unsafe to operate.
The registration shall be good for a period of one (1) year from the date of issue. No fee shall be charged for the issuance of a tag. Upon the renewal of the registration, the bicycle shall again be inspected by a person designated by the Director of Public Safety. & 58-7. Display of tag. [Amended 10-12-76 by Ord. No. 76-262; 4-9-84 by Ord. No. 84-565] Any person riding a registered bicycle shall display a tag. The tag shall be securely fastened to the bicycle for which it is issued in such a m anner that it can be seen clearly for a distance of ten (10) feet. 5802 10-84
& 58-8 BICYCLES & 58-14 & 58-8. Transfer of registration without authorization prohibited. [Amended 10-12-76 by Ord. No. 76-262; 4-9-84 by Ord. No. 84-565] No registration num ber shall be transferred from one person to another or from one bicycle to another unless reissued by the Departm ent of Public Safety.
A. Report required. Any person transferring possession of a bicycle to another within the Township of East Brunswick, whether by sale, gift or otherwise, shall report that fact to the Departm ent of Public Safety within three (3) business days after the actual transfer. B. Inform ation. The report of transfer shall be m ade upon form s furnished by the Departm ent of Public Safety and shall contain the following inform ation: (1)
The nam e and address of the person transferring the bicycle. (2)
The nam e, address and age of the person to whom the bicycle was transferred. (3)
A description of the bicycle, including its m ake, m odel, color and serial num ber, if any.
(4) If the bicycle was previously registered, its registration num ber. & 58-10. Compliance with traffic laws and regulations. [Amended 10-12-76 by Ord. No 76-262; 4-9-84 by Ord. No. 84-565] All persons operating bicycles in the Township of East Brunswick shall conform to all applicable laws of the State of New Jersey and ordinances of the township, particularly those dealing with the regulation of traffic. Bicycle operators shall obey the sam e rules as the drivers of m otor vehicles unless inapplicable or inappropriate.
W hen two (2) or m ore bicycles are being operated together, the operators shall ride in single file only.
No person shall ride on any part of a bicycle not intended for use by a rider, nor shall m ore than one (1) person ride on a bicycle unless it is designed to accom m odate m ore that one (1) rider or operator. & 58-13. Operation of unsafe vehicles prohibited. [Amended 10-12-76 by Ord. No. 262; 4-9-84 by Ord. No. 84-565] No person shall operate a bicycle within the township while that bicycle is in a defective, unsafe or dangerous condition.
Any police officer m ay inspect any bicycle at any tim e if he has reason to believe that it has not been validly registered, does not have its registration tag properly attached or is not in a safe operating condition. 5803 10-84
& 58-15 EAST BRUNSWICK CODE & 58-18 & 58-15. Impounding of unsafe bicycles. If a police officer determ ines that a bicycle is in so defective or unsafe a condition as to constitute a danger to the safety of the person operating it or to others, he m ay im pound the bicycle im m ediately. A bicycle that has been im pounded shall not be released until the owner has given satisfactory proof that the defects that led to the im pounding will be corrected prior to the bicycle again being operated in the township. & 58-16. Designation of violations. [Amended 10-12-76 by Ord. No. 76-262; 4-9-84 by Ord. No. 84-565] Any person shall be guilty of a violation of this chapter who: A. Fails to register a bicycle owned by him . B. Fails to report the transfer of possession of a bicycle. C. Knowingly operates or perm its the operation of a bicycle owned by him which is unregistered or which is in a defective or unsafe condition. & 58-17. Parents and guardians responsible for violations by minors. [Amended 10-12-76 by Ord. No. 76-262; 4-9-84 by Ord. No. 84-565] Any parent or guardian having custody of a m inor child who knowingly perm its that child to possess or operate a bicycle in violation of any provision of this chapter shall be guilty of a violation of this chapter. & 58-18. Hearings on violations before Director of Public Safety; penalties. [Amended 10-12-76 by Ord. No. 262; 4-9-84 by Ord. No. 84-565] In addition to any other penalty which m ay be im posed by law for a violation of this chapter, the Director of Public Safety, upon receiving inform ation that any person under the age of seventeen (17) has been accused of violating any provision of this chapter, shall require that person to appear before him or his representative for a hearing. The accused person shall be notified of the tim e and place of the hearing, of the tim e and place of the alleged offense and of the general nature of the acts constituting the alleged offense. Notice shall be served on the accused person not less than five (5) days before the date of the hearing and shall be in writing, but no special form shall be required. At the hearing the accused shall enjoy the sam e rights as a person charged before the Magistrate with a violation of the laws of the State of New Jersey or of the provisions of this revision dealing with the regulation of m otor vehicle traffic. If the Director of Public Safety is satisfied by clear and convincing evidence that the accused is guilty as charged, he m ay prohibit the accused from operating a bicycle for whatever period that he, in his discretion, deem s just; or, where the offender has been guilty of a flagrant or repeated violation of this chapter, he m ay perm anently prohibit the offender from operating a bicycle within the Township of East Brunswick. 5804

W henever the Director of Public Safety,(or) his designee(s), or the Code Enforcem ent Officer shall determ ine that it is necessary and expedient for the preservation of the public health, safety and general welfare, or to elim inate fire hazard, to rem ove from any lands in the township brush, weeds, dead and dying trees, stum ps, roots, obnoxious growth, filth, garbage, trash, junk, debris or other waste m aterials, the owner or tenant shall be required to rem ove the sam e within ten (10) days after receipt of written notice from the Chief Building Inspector or the Director of Public Safety, or the Code Enforcem ent Officer requiring the rem oval. & 61-2. Cutting of plant life near roadways required. [Amended 10-23-78 by Ord. No. 78-76] A. It is hereby found and determ ined that plant life m ore than two and one-half (2-1/2) feet in height, growing within ten (10) feet of any roadway or within twenty-five (25) feet of the intersection of any roadways in the township, m ay constitute a traffic hazard. For the purpose of this section, "plant life" shall m ean and include trees, hedges, shrubbery, brush and other plant life. 6101 3-90
