Article 4 - Obligations of the Provider
4.1 Service Provider's Mission
The Service Provider's Mission is to process the Client's Order(s) in accordance with the conditions set
forth in Appendix 2 - Description of Service Provider's Missions.
4.2 Terms and conditions for the performance of the Mission
4.2.1 Acceptance of the Mission in writing commits the Service Provider to perform the Mission as
defined in Article 4.1, which shall be as complete and as responsive as possible to the Client's requests
and expectations.

The Mission shall be deemed to be fully completed when the Service Provider has performed all the
services to which it committed itself in writing upon acceptance of the Mission.
This may include in particular :
● delivering the complete Specifications and validated by Nfinite within the time limit set forth
in the Order ;
● having the Specifications validated by Nfinite before sending them to Nfinite' 3D projection
services;
● allow the realization of a 3D projection of the project, in accordance with the Client's Order.
Nfinite shall define jointly with the Service Provider the list of Deliverables to be produced for each
Mission, according to the Order concerned.
4.2.2 In the event of delay in the execution of the Mission or failure to comply with the above
conditions, the Service Provider shall not be entitled to any remuneration provided for in the TCs and
may be excluded from the Nfinite Community and the Platform.
4.2.3 The Service Provider undertakes to deploy the necessary means to ensure the proper execution of
the Mission and to respect the requests and indications of the Clients. In this respect, the Service
Provider guarantees that the methods and techniques used are appropriate and in line with the needs
and expectations of the Clients.
The Service Provider also undertakes to personally perform all the Missions entrusted to it and refrains
from subcontracting any work.
4.2.4 The Service Provider undertakes to comply with the laws and regulations in force, in particular
those relating to the exercise of its profession where applicable, to data processing, files, freedoms and
intellectual property, and is solely responsible for the compliance of its Deliverables.
In particular, the Service Provider shall be solely responsible for the Deliverables produced during the
performance of the Mission. The Service Provider warrants that the Deliverables and the performance
of the Mission do not infringe any third party rights and in particular intellectual property rights.
Accordingly, the Service Provider shall indemnify Nfinite against all third party claims, actions,
losses, liabilities, costs or damages arising out of or in connection with the performance of the
Mission, including, without limitation, any claims for infringement or unfair competition, relating to a
design defect or due to a defect in the performance, against all claims relating to the quality or
durability of the Orders executed and to material damage caused by the same, the Service Provider
being solely responsible for the costs of any negotiations or litigation initiated by or with respect to
such third parties, without Nfinite being held liable in any way.
4.2.5 The Service Provider undertakes to carry out all declarations and formalities necessary for its
activity as a self-employed person and to satisfy all its legal, social, administrative and fiscal
obligations as well as all specific obligations incumbent upon it pursuant to the legislation on which it
depends in the context of its activity. Nfinite shall not be liable for any failure by the Service Provider
to comply with such obligations.
The Service Provider is hereby informed that the income it derives from the Missions it executes via
the Platform and/or Nfinite are likely to be subject to taxation due to its self-employed status and that
it is therefore required to declare them to the competent tax authorities. Nfinite shall not be liable for
any failure of the Service Provider to comply with its legal obligations.
