The only benefit plans which must be reported under Item 18(C) on the Form LM-1 are planswhich are entirely union operated. No report is required under section 201(a)(5)(C) or Item18(C) of the LM-1 with respect to plans established by collective bargaining which are operatedjointlyby employer and employee representativesorbyanindependenttrustee.

205.607VOLUNTARYRELIEFFUND

A Voluntary Relief Fund is raised by contributions at the time of the death of a member whohas voluntarily affiliated himself with the fund and the entire amount thereof is paid to the partyor parties designated to receive it. Any expenses incurred in the operation of the fund come fromaGeneral Fund and there isno guaranty as totheamountanybeneficiarywillreceive.

This plan would seem to be a type of benefit plan within the meaning of section 201(a)(5)(C)of the Act. It is necessary under section 201(a) of the Act to either submit a detailed statement orcopy of a document with references to the specific provisions thereof which contain such astatement, showing the provision made and procedures followed with respect to each such plan.In addition, it would appear to be necessary to report receipts and disbursements of theAssociation pursuant to the plan in the annual financial report required to be filed under section201(b)of the Act.
