4.18 Companies Act 71 of 2008
A company is a separate legal entity as from the date of incorporation and continues in
existence until it is deregistered or liquidated, irrespective of whether
there is a change in
shareholding.
The Companies Act requires that companies must submit annual returns to the Companies
and Intellectual Property Commission (CIPC) which include information such as confirmation
that the company is still in business. For more information, visit

4.19 National Small Enterprise Act 102 of 1996
This Act provides for the establishment of an Advisory Body and the Small Enterprise
Development Agency to make provision for the incorporation of the
Ntsika Enterprise
Promotion Agency, the National Manufacturing Advisory Centre and any other designated
institution into the Small Enterprise Development Agency and to provide guidelines for organs
of state to promote small enterprises in South Africa. The Ntsika
Enterprise Promotion Agency
is an agency of the Department of Trade, Industry and Competition that facilitates non-financial
support and business development services to SMMEs through a broad range of intermediary
organisations.
